SET(O) or SET(M) for wife?

Post by smkengr » Wed Mar 06, 2013 1:57 pm

Hello
I am on ILR since 28th Aug 2012. My little one has got British nationality.

My question is on which form my wife should apply for ILR? SET(O) or SET(M)?

Last time when I went for PEO service we had FLR form filled for my wife but they refused to process and then i had to fill the form (Tier1 dependant) for her extension on Tier1 dependant though I had ILR that time.

I would really appreciate if someone clarify this to me.

many thanks.

When did you get your wife's ILR? how can we check weather someone was granted leave on tier1 dependant or ILR dependant as I was on ILR at the time when I applied for wife's extension.

I have seen few of the threads refer to go for SET(M). Still can't find any relevant doc from UKBA.

Can someone else confirm this as well?

Also if you can mention whether you went for PEO service or send documents/application by post?
I need to know if we have to send my passport and ILR Bio-metric card with her application?

Thanks in advance.

Hi ilrdep

Also do we need to leave Section 9 (Points Scoring Assessment) blank?

1. you need tick on "Other purposes"

you can mention in Other purpose reason column stating that "PBS dependent of ILR holder"(Your name)

2. Yes

One of my friend called me that he called UKBA to check which form he has to fill for his wife (almost same case as ours) and he was told Set(M).

Please help which form we have to fill? SET(O) or SET(M)?

Many thanks.

Thanks vinny for replying.

What do you suggest if I go on PEO service and keep both form filled with me just in case they ask for other?

Secondly, can Set(O) appointment be used for SET(M) just in case if they say you need to submit form set(M). I booked appointment for set(O).

Please advise

Form SET(M) must be used if you are applying for indefinite leave to remain in one of the following categories:
- spouse or civil partner of a person present and settled in the UK

Well its bit confusing.

I am thinking to fill both forms just to be on safe side.

Do you know if still its the same in Solihull that they review the form first and then ask you to go for payment?

Will set(O) PEO appointment be used for SET(M)? just in case !!

Do we need a complete set of copies of everything as well?

waiting

yes, even I got confused if you see my queries initially.
It is quite common.

Solihull have now changed the process payment first and then case worker will have look in to your case.
