Yeah but a proof of payment to HMRC is in category one which you may use if you are unable to send a proof of self assessment with HMRC so I am not too sure what to do.

Yes you acquire PR automatically, You will just be applying for a document to prove your PR. I'd say it would be harder because you have to have enough evidence cover five years instead of just the current period for a Resignation certificate or residence card. Yes you are correct it's five years as a qualified person, your wife will only count from when she became your direct family member (unless she held a family permit or residence card prior to that as a extended family member) so that will be the day you got married in in the UK or the day you came ...

Just tried again, 10am- off-peak time, now a new message says "sorry, due to high call demand we're unable to take your call" and tells me to go to their website. I think they're trying to minimise the calls but this is too aggressive, I've been trying to reach an adviser since the 1st of April!

It was refused since they say I didn't demonstrate that I exercise treaty rights in the UK. after sending few more evidences they reconsidered and issued RC.

Thanks mate once again, I'm not to stressed about it, but with the amount I've paid the application, appeal, accountants etc. it wouldn't hurt to get at least another 80 quid back ;) In any case, it's completely confusing- the tribunal are telling me that it's not the home office because I withdrew ...
