I'm a little concerned about the sister's comment. Even if you were threatening to revoke your sponsorship, it does seem a strange statement for her to make - as does your wife's request (no matter how generous one tries to be about family ties, separation, anxiety etc). Like others here, I'd advise...

The 14 year rule isn't a given anyway. It's definitely living on borrowed time, and will most likely go when/if the Conservatives win the next election. My opinion only. Why don't you try for Article 8? There is discretion to consider those who fall between the 10 and 14 year gap. You'll need a whol...

she was refused ilr and the home office didnt even give her flr. I dont know why they did this, but they only refer to her not having passed her english as the reason why she was refused ilr Hmm. Normally the Home Office would send the FLR form with the refusal. However its not their responsibility...

At present those organisations supporting victims of domestic violence would only receive payment for the cost of finance and accommodation after ILR has been granted. Given that most DV agencies are almost flatlining from the lack of funds, let's hope that UKBA resolve this issue soon - or victims ...

Hiya

Well I only just got here. :o

I assume you mean Discretionary Leave - there's no such thing as description leave. Not yet anyway.

If your application was sent in on time and was successful, then the time that your case was in the Home Office would count as legal residence.

Do the funds have to be in YOUR account or can you declare a sponsor such as a parent and have your sponsor demonstrate HE/SHE has the funds?? Also, I think you meant 1st October 2009 as the 28 day requirement comes into effect by the end of September 2009. If you apply before 1st October, you will...

How about the Isle of Man, Ireland or the Channel Islands? He should be all right to travel there for now..

Anywhere else, he's leaving the Common Travel Area and as pointed out aready his leave is very likely to be lapsed. This may result in a refusal when he tries to re-enter the UK.

henny penny, it may seem like we're being harsh but in actual fact everyone here has given you some pretty realistic advice. The Home Office will only deal in issues that are supported by objective evidence. As I see it (from the account you've given so far) your main problem is that your partner is...

Go back to Jamaica. Take your wife and son with you, if she can't manage without you. Apply for an entry clearance as a spouse. Come back legally. Ouch. :) Well hennypenny, as cold as it may seem, you've just had two very sensible and concise bits of info/advice given you in the 2 posts above. Movi...

You can still hand in the evidence you left out of the initial application. A sensible ECM will look at it fairly and decide whether or not it's worth wasting the Immigration Judge's time on an appeal that is highly likely to be allowed. Bear in mind that any new evidence you obtained - after the re...

Re: Apply ILR on domestic violance.A very strong case

You're quite right about the DV fee, greenie (a misnomer if there ever was one! ). My view is if the exemption is there - go for it. (It's not failed yet.) But I suspect the Corporate Bank of UKBA will be coming down on that policy harder now it's got all these customer charters and service ...

To me it looks like the refusal was correct - the ECO judged on the documentation provided and if it wasn't enough he was right. I think I'm right in saying an appeal is only for when the ECO has made an error in law or judgement based on the evidence he had at the time. I feel u'd have been better...

Hmm.. if you politely request a review (" so sorry for the ommission, kissy kissy" etc) it may yield results. Provided that the evidence you've supplied pre-dates the refusal decision (eg some old correspondence between the two of you that you forgot to put in), the ECO has to look at this...

Hi jine, An MP would usually only be involved in a particularly harrowing case that had dragged out over a long period of time. Your appeal is simply going through the standard process; it's going to take a bit longer than a month for it to be dealt with. In theory there is nothing to stop you from ...

If they've sent back you back the form and all your documents, your application will have been deemed as invalid. Check if it says this on the letter you received from them. In which case you need to submit the full updated FLRM to the same address shown on the application form. Which should be UKBA...

djb123, the point is of course that someone who is only ever in the UK as a visitor will never get ILR, and thus would never be eligible to apply for Naturalisation. Strange as you might find the rules, in this respect, they are actually quite clear. I look forward to hearing whether Arzoo's husban...

Re: Tuition Fees & the 28 days requiremnts

I have finished my Masters and I would like to renew my visa as a student visa. Is it the living expenses and the tuition fees that I should hold in my account (for 28 days) or it is just the living expenses? Please help Cheers! You need to show both unless you have already paid for the tuition fee...
