Re: SURINDER/EU STATUS.

No she wasn't part of the journey (is that an outright refusal?) but as it stands now she is financially dependent on the family. She can't access the Labour market until her legal status is established. Thanks. According to my understanding, as dependent wasn't part of SS route & sponsor is only ...

Re: SURINDER/EU STATUS.

My understanding is the BC 'proxy EEA national' can sponsor any/all familymembers who were part of the SS journey via a.n.other EU memberstate. Did parent/dependent participate in the original SS sojourn? If so and there is still demonstrable dependency and you gave good supporting evidence, why ...

Re: SURINDER/EU STATUS.

This is not very clear. What do you mean by a ' Surinder application ' ? is it an application for: FP, RC, confirmation of PR, (citizenship, passport) ? Who is ' main applicant' - is that a non-EEA depndent of a BC sponsor? Who is ' dependent' ? is that a non-EEA parent? (an in-law of BC sponsor ...

Surinder/EU status.

Hi All, Kindly shed some insight to this. Surinder application was put in just over two years ago, application was put foward with (Mother ) as a direct dependent . Both application was refused on first instance , because dependent didn't not have a valid national passport 'then' and some ...

Re: Application Type.

Can you actually engage Zambrano at the point of entry and how do you go about that. no - the BC children would have to be resident in the UK to engage Zambrano. See: https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/257807/zambrano.pdf 1. It's not possible to switch from ...

Re: Application Type.

Thanks all again for you input.

Can you actually engage Zambrano at the point of entry and how do you go about that.

Kindly 'disregard' the last child when responding.

Also what if she decides to pursue other EU countries under EU Treaty Law? What her options?

Thanks.

Re: Application Type.

This fails on several counts and the following five are just for starters without going into discussion about custody etc... 1. It's not possible to switch from visitor to any other category while in the UK. 2. If the Immigration Officer at the UK port of entry suspects an intention to overstay ...

Re: Reconsideration / on gong appeal

The caseworker gave you a wrong advice. He can consider the case while appeal is pending. If the reconsideration goes in your favour then withdraw the appeal. Seems to be intentionally misleading you. If you withdraw your appeal and he decides to stand on his original decision , you can not appeal ...

Re: eea 2 surinder singh please share your experience

Got the COA today dated the 9th ( Cheeky sods) with right to work. My mother on the other hand just got the COA with no explicit statement of right to work but nothing barring her if she chose to in terms of human desperation to survive. Man made is a law joke.

Re: eea 2 surinder singh please share your experience

Interesting you got a letter acknowledging your application, sent my same day as yours. They more keen on debiting my account than sending that out ( not too keen about the letter anyways) rather have the COA. Have they debited your account aswell? If yes , could you kindly me tell the date. All ...

Re: eea 2 surinder singh please share your experience

I don't really know tbh. i just thought we can only apply before the 1st Jan else we wont get in. I did move to Ireland and exercise my rights. But husband also has a deportation order from the UK from 2010. So as I gather as we applied before the 1st Jan, we will can appeal and we can re-apply ...

Re: eea 2 surinder singh please share your experience

If we was refused we can only try and appeal. I don't think we can re-apply as we don't qualify under the new regulations.? what gives you that clarity that you don't qualify under the new regulation? Did you make Ireland your Principal residence ? You applied before 1st, the old legislation ...

Application sent on 23rd, Processing fee debited on 31st. I applied without EEA Family permit but in possession of a Resident Card from Ireland. Tried to apply for EEA Family, went for the biometrics appointment at the UK embassy in Ireland, on getting there, the staffs said they will not be ...

Well there is no change in documents section as well. how one will know what documents he/she have to provide to prove center of life and integration requirements. That's where the 'abuse of power' comes in, it will be open to any interpretation that suits them , sooner or later the official ...

Re: Amendment to EEA Regulation from 1/01/2014 Singh diluted

UKBA have released the new EEA2 form but I can't see any changes to SECTION 5 – SURINDER SINGH CASES . Also no changes to documents section of the form. I can't find new guidance as well. what you think guys? I think it's underneath the document requirement for Surinder. They seem to require more d ...

I am a' visa national' and yes I still used just my passport to enter without a visa. The law is a joke. I'm confused, you mention wife and durable partner in the same post. What is your marital status? 'Wife to be' got carried away. Fiancee to be precise. We've been together 2 years approximately, managed to gather 18 months documentation that can prove 'durable' relationship. Am hoping that they ...
