And now for the final instalment of this drama - my husband received his British passport on 31st December :D A fantastic end to the year for us. Just wanted to say that you should never lose hope no matter how awful the situation is. Happy New Year everyone x

This is a good start, but do try to get a full statement of earnings from HMRC and also try to submit payslips etc. Can your wife not contact her previous employers and ask for duplicate P60s or contracts of employment?

She can call HMRC and ask them to send her proof of her earnings. Think that they can go back 5 or 6 tax years. Received the outcome of the reconsideration today. Bad news:-( Apparently the original refusal stands. My mother-in-law's EEA2 application was refused as well. Appeal allowed for both. Incredibly frustrating!

My husband was an overstayed too, but when he applied for his EEA2 in 2007 he received his RC in 5.5 months. So I don't think that being an overstayer should matter - but who knows when one has to deal with the incompetence and bureaucracy of the the UKBA.
