Eu Treaty files waiting time - EU1 or EU1A

For EUTR1 this unusual. They are obliged to issue all qualified family members temporary stamp 4 while waiting for their final decision unless you provided them insufficient documents(eg. EU citizen employment)

By the email they sent you, you have provided them what they asked for. You need to tell them you haven't received temporary stamp 4 and you need to work/study.

Send them a registered letter and a new email again(don't reply on what they already sent you). Remember to include your application number, personal
number, address and name


The subject should be;
EUTR1 - Temporary stamp 4

Hi,

Give it 4 weeks and if you don't hear from them contact them again since they didn't even issue you a temporary stamp 4 which you have right to, as a qualified family member. The mistake you made was not contacting them when you didn't hear from them after 1 month you submitted.

I think with your case and from their reply, they will issue you the final decision "Stamp 4EUFam" not temporary stamp.

Hi, i just recently got my approval letter and im not sure i understand it correctly(?)
It states i must go to immigration office for my Residence Card (I already have an IRP card, is this different?), and it also states that i may be eligible to apply for permanent residence and must submit an application before expiry of my residence card; required that i submit it before 08/06/2028- is this date the expiry of my residence card?
On another note, it states i must go to my local Immigration office which is Anglesea Street Garda Station but the waiting times there are crazy, could i go to another office with less waiting time or it Must be the one closest to me?

a week after you.... but mine is EUTR1A. yours should have been processed by now from what I have heard. I did you contact local TD ?

I believe the card you have is Stamp 4 (Residence permit) temporary given to you while processing your application. The Stamp 4 EUfam is the actual Residence card only given to EU family members. All IRP have a card format.

The 08/06/2028 is your Stamp expiry date and you need to apply for permanent residence 6 months before this date.

If you live in Cork city area you can only register your new permission at the Anglesea Street Garda Station.

Unless you relocate oustide that area then you can register your permission at the Garda Immigration office or HQ there.

Thank you. Just a bit worried now as my temporary permission expires on the 19th now and the Cork Garda Station are still processing appointments made in November. Im currently working and not sure if there would be an issue as my permission will expire before i can get the actual Residence card...

Hi,

Normally what people do in your situation is if the appointment is after or not received before expiry of your current stamp, you give a print out of the appointment or the email you sent them requesting for one, and a copy of your new permission letter to your employer. You will be allowed to remain in employment.

If you already go for your appointment then your IRP expire before you receive the new card, you just provide the employer same as above.

Just one last question can two different families apply eutr1 from the same address.

Of course, 2 different families can use same address if they also live there. All what they need to provide is proof of address. If they are not the main tenants on contract, they can provide a letter and utility bill from the rentee. If possible, a letter from the landlord confirming they live there (This not compulsory).

If they have recieved any correspondence from a government office (eg. PPSN) or bank to their address they can attach it.

It is almost same and somehow straightforward because it falls under sufficient funds. Unless the EU national's income is not sufficient (example income below €10,000 per year) then they can delay the application to see if the EU citizen will claim any welfare.

On follow up today... I got a response... instead of the general response we all get. I was told decision will issue shortly. What could this mean ? or is it just another response to shift the attention ?

Two weeks ago i have snd them a registered post regarding stamp 4 and acknowledge . But I’m afraid i didn’t get a reply from them now i’m really worried i have tried to email them but never heard anything from the email as well. What should i do.

Sorry for the decision. All is not lost yet, since the case worker refused you based on the evidence submitted about your relationship, apply for review with EUTR4. On section 5 tick

*The decision maker failed to consider information supplied*

And on second 5 C write why you believe the decision is wrong.(You provided enough proof of your relationship outside the state and you have been living with your partner for 8 months in the state)

Now you have upper hand, use your time you spent with your EU partner in the state to counter the decision.
(Provide evidence of your utility bill, landlord confirmation of you and your partner and any documents with same address from the time together with your partner in the state and also provide evidence of any joint stuffs you both have been doing together since if possible)

Add a 'few' of what you already submitted in your previous application (evidence of messages or chats and any trips you both had together outside the state).

Passport stamps or tickets of any trips together if possible.


*6 months of living together is enough to sponsor your non EU partner via EU law with no child if arrived legally.
