British Citizenship null and void - supreme court decision

There has been an ongoing battle for many years involving Albanians such as Hysaj & Kaziu and others V SSHD who had their Naturalisation Certificates and passports cancelled by Home Office on deception grounds.

The Home Office decided that applications made by some albanians claiming to be from Kosovo for ILR and later Naturalised as British Citizens had never obtained British Citizenship and their naturalisation was considered Null and Void(never taken place).

The Court of Appeal agreed with the Home Office but the Supreme Court has allowed the appellant’s and confirmed that the Home Office had not applied the Law correctly.

The appellants for time being are British Citizens and it is a good news for people on the same situation that have been left in limbo for over 4 years appealing this decision and were waiting the decision of this test case.

It is a good decision, but the effect is not long time, as the Home Office may well take a decision to revoke those certificate, although if she proposes to do that, the children who qualified under section 1(3) and 2(1) will continue to so qualify.

Since the BNP members have been allowed to work in the Home Office the nationality and immigration instructions have been updated to suit ther needs. 1) the Windrush scandal where people were penalised because of colour of their skin. 2) Albanian nationals who couldn’t be deprived of their british citizenship under Deprivation of Citizenship law had their citizenship nullified and families members been penalised. Even now that the supreme court has ordered the home office to revert back their citizenship the home office is not processing their claim and refusing tonissue passports. It is called pure beloved.
