One parent having ILR is enough.

Hi Jambo,

From what I checked, to use MN1 for kids, BOTH parents need to have ILR (unless sole responsibility, one party dies etc.). Could you show where it says "one parent having ILR is enough" please?

also the documents to be sent include : Parent's marriage certificate.

The law is quite clear.

The form asks for both the father and mother ILR date but if not applicable, just leave blank.

Marriage certificate is not required for section 1(3) applications (I know it is listed in the guide but then the guide doesn't list the parent's passport showing ILR which is a major piece of evidence required for section 1(3)).

Oh, you are right. My previous information was wrong. I am misled by the wording on UKBA site "Section 1(3) applications - children born in the United Kingdom to parents who are now settled in the United Kingdom", as it uses "parents" and "are". I believe I checked other places where contain this wrong information as well.

For the marriage certificate, it is clearly listed in the guide, which I think should not ignore.

For the parents passports, do you mean we should send parents original passports as well? or photocopies with the ILR page are enough? (They have all the data in computer anyway.)

Original passport. If you don't wish to send the original passport, consider using NCS.
