ILR application

Hi,

My ILR application is due in OCT 2013 . I am a current Tier 1 visa holder. Am I eligble for ILR based on the dates of my residence in UK from 06/11/2008 - till oct 2013 ? my visa runs out on 30 oct 2013. Do I have to wait till last day to file for ILR to come as closer to 5 years as possible ?

I have self assessed to get below points:

Age- 20 ( At the time of first application )
Degree - 30 ( Bachelors)
Income - 25 ( £26000 annual salary : Proof -Payslips and Bank statements)
Uk experience - 5 points

Table of leave absence from Uk to be attached as mentioned in this forum.

Request you to kindly confirm if below gets me the required 75+ points for ILR.

In addition, my wife joined me in UK as Tier 1 dependant from 01/2011. Will she also be eligible for ILR at the same time ? Kindly confirm.

Is there no maintennance requirement in ILR as Tier extension ? Does my wife have to fulfil any criteria to be eligible for ILR ?

Many thanks, I have read the guidance posted on the website. However, if you could pls reply to this below query:

Will I be short of 5 years since my 5 years would be completed on 05/11/2013 but my visa is until 30/10/2013 and I will apply by 30/09/2013 ?

You may apply for settlement between 09-Oct-13 and 30-Oct-13.

Many thanks. Sorry I made mistake on my visa expiry. Everything is correct except that my visa runs out on 30/09/2013. I mistakenly wrote 30/10/2013.

Kindly confirm if I can apply for ILR ?

Just to clarify can you confirm the following:

Date of entry into the UK: ?
Date the visa is valid from: ?
Date the visa expires: 30/09/2013

Date of entry into the UK: 06/11/2008
Date the visa is valid from: 10/09/2008 ( Initial Tier 1 visa granted from India)
Date the visa expires: 30/09/2013

In addition, total number of days absent from Uk since 2008 in only 44.

The earliest you should apply is 28 days before "30/09/2013".

The following concession will apply to you, as you short fall of the 5 year residency period due to late entry into the UK but within 3 months. Therefore the the CW may consider the period between EC (10/09/2008) & Entry (06/11/2008) towards the 5 years as indicated below:

Applications that fall short of the five year continuous period
In some cases, applicants may have been granted five years continuous leave, but due to delayed travel will not have spent five years continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the five years, provided this period was not longer than three months.

New rules in Family migration from 9th july 2012

I have a query after reading the guidelines for family migration after 09th July 2012.

I and my wife intend to apply for ILR in Sept 2013 after 5 years on Tier 1 visa. I am aware that we both will be required to pass Life in the UK test.

However, kindly confirm if we both also have to pass B1 level CEFR test in speaking and listening as well.

ILR for Husband

My husband has been here in London since 08th September 2010 and i would like to apply for his ILR. (Pakistan)

When and what date should i apply?
What 6 documents should i send?

If he has done a degree in English in Pakistan is it accepted? or does he need to do The Life in the UK test?

Could someone from the forum kindly reply to my query raised on 10/07 asking if me and my wife ony have to give Life in Uk tst and not IELTS as we are filing for ILR in Sept 2013.

In addition, kindly clarify below.

I had shown income of £28,000 during my Tier 1 extnsion last year. I now have a salary of £25,000.

All applicants now have to meet the same income requirement as they had during their last leave. Does it mean income has to be the same i.e. in the same range £26,000 - £28,999 or can it go lower £23,000 - £25,999 as long as applicant meets the points to file for ILR.
