ILR overview, please =)

Dear all,
I am a frequent user of this Immigrationboards.com and I have to say big thank you to everyone helped me.
It's coming to close to 5 years since I stayed in the UK with HSMP. As I am starting to prepare for ILR, I thought it might be good idea to run through my situation now so that I will be confident when I apply ILR for myself and dependent visa for my wife, in April 2013.
1) My situation
* I hold New Zealand passport
* First entered UK with Working Holiday visa on 14 Dec 2007 (Had HSMP part 1 approved already)
* Fully granted HSMP on April 2008 for 2 years
* Successfully extended HSMP for 3 years and it expires on April 2013
* I believe I qualify for the points for the following reasons:
a) Degree : Bachelor : 30 points
b) Income : Between £32k - £35k : 35 points
c) Age : 27 (DoB is Feb 1981) : 20 points
Total : 85 points
2) My wife's situation
* Holds Australia passport
* First came to the UK on Aug/2005 for study (Master degree at one of the UK universities
* Recently was granted for dependent visa based on my visa. This was granted on Feb 2012
Here are some questions I have:
a) Do my wife need to pass the Life in the UK test?
b) Does she need to complete different form for dependent visa? If so, what form?
c) She has joint account with me with balance over £2k and this will be remained until we apply for the ILR + dependent visa
Also, if there is other things that I need to know, please kindly provide your advises and expertise.

Thank you for your reply. Just a few questions around your kind answer to make sure I understand it clearly.
My wife is applying for dependent visa not ILR because:
1) She has not been living in the UK for longer than 10 years (she stayed in the UK for about 9 years so far)
2) As far as I know, we have to live together for at least 2 years (correct me if I'm wrong), but we only lived together for about 10 months
3) She was on PSW prior to this dependent visa on my HSMP and her dependent visa was granted on Feb 2012
(I mean, it would be great if she can apply for ILR as a dependent of me, but can she??)
I am applying for ILR before April 2013 and so, my wife needs to apply for a visa as well since it is dependent visa on me. Can she apply for her dependent visa using the my ILR form or does she need to complete separate dependent visa application form and send in one envelope? If she needs to complete separate dependant visa application form, does she still need to sit the Life in the UK test?
Just help me to understand it clearly.

I am sure I have read somewhere on this forum that if your partner and you have been living together for last least 2 years and you can prove it, she can apply ILR with you. This should confirm

That's true, she will have to use FLR(M) to apply as for extension of stay as a dependant of a settled person

She can't; giving the fact that you have not been living together for long enough
I am applying for ILR before April 2013 and so, my wife needs to apply for a visa as well since it is visa on me. Can she apply for her dependent visa using the my ILR form or does she need to complete separate dependent visa application form and send in one envelope? If she needs to complete separate dependant visa application form, does she still need to sit the Life in the UK test?
She can apply for her extension with your application but on a different form. You will need Form SET (O) and she will be using form FLR(M).
She does not need to sit in Life in the UK test for extension of her visa but when she's ready to apply for ILR she'll have to sit in the test
Just help me to understand it clearly.

Dependent visa extension

Thank you very much.
So, I will prepare ILR application form for myself and dependent PBS form for my wife. Since she is on her dependent visa for the first time, and now she will be having her dependent visa for the second time. Is it extension or new dependent visa? Either way, is there different form for each case or does it not matter?

So, for extension of my wife's dependent visa, do I use the same form she used when she first got her dependent visa? Also, she can apply for the visa in the UK, without going back to her country, I assume - am I right?

Hi Gurus, Sage and everyone helping me,
Me and my wife has decided to use the PEO service. On the website, it says the appointment should not be longer than 42 days from today and there is no availability.
How are people making appointments well in advance?
Please let me know.

They aren't. The earliest anyone will be able to book an appointment is 42 days in advance.

Hi,
In addition to the above questions that I have, I have a few more questions.
My HSMP was first granted in 2008 for two years and then was extended for three years in 22 Apr 2010. On the income section on SET(O) form, do I pick points for Tier 1 (General) Migrant under the Rules inplace before 6 April 2010 because I initially was granted HSMP in 2008, or should I choose the one for after 6 April 2010 because my second phase was granted after 6 April 2010?
Also, I get paid monthly, so for the proof of income of 12 consecutive months, I should have 12 months pay slips.
Now, my 13th month payment came a bit earlier than usual and it is within 365 days period. Would I be able to include this to make my application stronger?
Please kindly advise and many thanks in advance,

1) Rules inplace before 6 April 2010
2) You don't need to include 12 months of payslips if you qualify with the required points using less. Adding more payslips will NOT make your application stronger, it will just add to how much more cross checking the case worker would need to do, to assess & approve your application. Stick to what is required, and it will make life easier for everyone including yourself. 12 consecutive months income is the maximum you can use, so if your 13th month of pay is outside that earnings period, it will not be accepted even if you do include it.

Questions completing the SET(O) form

Dear Seniors,
Now I am completing SET(O) application form. Your kindess to guide would be much appreciated
1) Q2 (page 4) - Contact name in the UK if different from that of the applicant : Is this asking for my name?
2) Category (page 9) - Section A or Section B :
I started as HSMP for initial 2 years and then HSMP Tier 1 for another 3 years. In my case, am I Section A or Section B?
3) Question 6.1, Section 6 (page 13) - Date first entered the UK (which this application is based)? : I first entered the UK with Working Holiday on Jan 2008. Then I received full HSMP in April 2008. Do I put Jan 2008 or Apr 2008?
4) Question 7.11, Section 7 (page 17) - How long have you lived in the UK? : This will relate to the above question. If I count from the very first day I entered the UK, it will be slightly more than 5 years. However, if I count from the date I was fully granted HSMP, it will be less then 5 years. Please kindly advise.
5) Points : This is how I calculated. Can someone kindly check if I have done it correctly, please?
a) Income : 40 points (£35,000 - £39,999 : as of before 6 April 2010)
b) Qualification : 30 points (Bachelor's degree as of 6 April 2010)
c) Age : 20 points (under 28 when I was granted my first HSMP 5 years ago)
d) UK experience : 5 points (always has been working in the UK for last 5 years)
It brings the total points to 95 points. Have I done it correctly?
6) Point calculator : Is it something I need to print from somewhere?
This should help me completing the application form. Your kind advises and sharing knowledges and experiences would always be much appreciated deeply

Hi Seniors and helpers,
Thank you very much for your helps so far. I was lucky enough to be able to secure the Croydon office before 6th of April, for myself and my wife - thank God! And now we cannot wait to get the ILR and the new visas!
Just final a few last minute questions:
1) Documents - I am taking the followings
a) Cover letter
b) Completed application form - SET (O)
c) Two photographs with my name at the back of each photo
d) Life in the UK test result
e) 12 months payslips
f) 12 months bank statements
g) My current and previous passport
Just regarding Biometric residency card, I never had one since my visa was always a stamp on my passport. I am applying for ILR through PEO service. Do I need to arrange something in addition or having an appointment for ILR interview will cover everything?
Also please kindly advise if there is anything I should take in addition.
2) Documents - my wife is taking the followings

c) Two photographs with her name at the back of each photo
d) Joint bank statement showing £600+ for last three months
e) Current and two previous passports
* For my wife's PBS dependent application form, we have a few enquiries :
a) C4, page 8 : I (the main applicant, SET (O)) do not have the reference number because I no longer have letter from the UKBA. Can I leave it blank or should I at least put the the number on my visa stamp on my passport?
b) G1, page 14 : My wife's passport is South Korean passport, which she renewed in London. Should she say the 'place of issue' is London or Seoul?
Also for my wife's application, please kindly advise if there is anything that we need to take.
