Hello All,
I am looking for your advice.
I came to UK in Nov -2007 on Workpermit and changed to Tier 1 from March-2009.Valid until June-2014.Completed 5 years by Nov-2012.
Lost my job by Dec-31-2012.Still looking for work.In those whole 5 years i was fully employed with an India employer.I have all payslips from 12 months of the last 15 months.Passed Life in the UK test .
I went to India in Jan and returned mid march.Got a PEO appointment next week with Liverpool PEO.
1.will it be a problem to apply without a job? I am actively looking for work.
2.My Indian employer asked me to fill some HMRC forms at the end of employment .looks like one of the form states that i am leaving the country.
I am yet to notify HMRC that i am back.Should i do this before i go to PEO?
I have outside UK in the last 5 years around 175 days.out of which 77 days is the single largest absence from the last 2 months.
Could you please advise ok to apply now? or you see any problems.
I understand immigration rules changing from April-6 and i will not be able to ask my previous employer to provide a letter for any of those absences.

You are on Tier-1 and not on Tier-2 currently , so you dont have to be in an active employment. PERIOD.
What you need to have is enough points. Now if you have the appointment next week then you are just about enough time to include your pay from Jan to Dec for scoring the points.
I think you should have applied for ILR and then gone to India as that would have ensure you could use your salary from Jan till Dec fully.
The form that your ex employer asked you to fill is for P45 etc and not that you are leavning the country, they dont have to do that for people who are on Tier-1
Did you ex employers know that you switched to Tier01?
You dont have to notify HMRC anything of your coming back, you have to only pay tax if you earn any income.
YOU ARE ELIGIBLE, dont delay it any further, as you might lose points because remember you can only claim points for past 15 months pay and next month you will lose january, you have already lost part of it.

I totally agree with you that i should have applied before going to India.
I am getting ready with all my documents and i will keep you posted on the result next week.

I got another question.
In the SET O -form there is a question.
Are you working in the UK? -I am thinking to answer 'YES'.as this seems a generic question.
While explaining my absences i would say break after loss of work and now actively looking for work.
Something that looks ok?

Ok, this is just my take,others feel free to comment , challenge.
Working in UK - I will write Yes, as it is generic and you are in effect on a work visa in the UK.
In the reason for absence, i wouldnt mention break in empliyemnt or anything on those lines.
I wiuld just say personal visit and make up a reason to be in India.
This is not false information and infromation presented to assist your application.
If the case worker asks you, don t say i am looking for job,, just say you in the interview process with a few companies, again information presented to help your case and not deception,you arent required to be employed

Also remeber,only you know that you lost work, they dont, for them you could have quit.
So do not talk abot loss of work , not just to to ukba but even to interviewrs, unless you have a termination notice for mis conduct

Ok,sure. Due to budget constraints i was asked to leave.

Looks like you are stressed because of break in employment.Dont worry that is a no issue.

Yeah.sure. Thanks for your valuable suggesstions.
Yes i meet all the crtiteria except being on the job.
I also moved out to a cheaper renting area after coming back from India
last week.
My documents all show my old address.I think this is not a problem.
I will provide my new address for communication.
Yes i am stressed out,exactly.

Congrats Georgy, You made the application in time i.e before this April 6th rule change which throws a lot of confusion to the already confused situation!
