Spouse ILR

Dear Sir,

I got ILR last month (17th April 2013) on long residency (10 years). I came to this country on September, 2002 as a student and my wife joined me as a student dependent in October, 2003 and continued as my dependent until March, 2009. Later, I switched my visa category to Tier-1 General and she was my dependent upto March 2012. Applied for extension and got visa for another two years until May 2014 as Tier-1 dependent.

Now that, my question is can I apply for her settlement (ILR) as she stayed as my dependent for more than two years as per rules (before 9th July, 2012). And also, as my dependent for more than 5 years.

Please advise what application form can I use for her settlement.

I understand that I cant apply for her settlement on long residency as she got breaks in 2005 (262 days absence) and in 2006 (179 days absence) and 2008 (141 days absence) and 2009 (103 days absence).

I request you to kindly please advise whats in her best interest.

Form flr(m) then set(m) assuming she has qualified the 2 year period as a PBS dependent as per pre-July 2012 which is indicative of your post.
