Hi,

I want to apply for settlement (spouse). I need an urgent PEO appointment because back home my brother is getting married in two weeks time. I have tried to book through UKBA (online) but the dates I get is 31 July which I don't want it. I need the one by next Monday to Thursday. When I tried to search using different category like PBS dependent, I get the date nearest date 12 July. If I book this appointment will there be any problem as I need SET(M) appointment. Please advise.

Thanks

You should book the right appointment, it's a risk whether they would accept 'an honest mistake' and see you. If you have the time you could do it and plead when you get there. At the end of the day it depends on who sees you. Have you tried looking at other PEOs?

Thank you for your reply. I have managed to get a slot on 11th July for the application type (FLR-M). Originally, you have advised me that I can apply for settlement for my wife as she is my dependent under points based and falls under old rules. Firstly, try the luck for SET-M. If not, first the FLR-M and then SET-M on the same day. I hope this slot will not have adverse effect. Please advise.

If you got your ILR due to long residence I think you did? She will have to firstly apply for flr(m) and once that is granted set(m) using immigration rule 287(a)(I)(d). You can't do both on the same day (well I very much doubt you can). So get two appointment booked.

According to some recent applicants they are allowing direct to set(m) rather than having to submit flr(m) first. However, it has not been consistent so I would have both flr(m) and set(m) completed and ready. Let us know how you got on. I always thought it was just a waste of money to make applicants go via flr(m) first when the pbs dep visa was expiring after the qualifying period, seems they are now allowing it. Though, be prepared to have to submit flr(m) first.
