Hi,

I am confused if I am eligible for ILR or not. Below is my case in detail:

Got Tier 1(general) on 16 Feb 2009 for 3 years and got it extended for 2 years in 2012 till 15 Feb 2014

Entered UK on 3rd march 2009 till 31 may 2009 for a project assignment. Entered UK again on 19th October 2009, since then I am here but have few gaps for holidays as follows:

Time period per year Absences(days)
16 Feb 2009 - 15 Feb 2010 155
16 Feb 2010 - 15 Feb 2011 39
16 Feb 2011 - 15 Feb 2012 22
16 Feb 2012 - 15 Feb 2013 73 (60 days working from home in India
but was getting salary here +
13 holidays)
16 Feb 2013 - 15 Feb 2014 9

My queries are:
1) Does the 90 days rule apply in the first year of the ILR qualifying period?
2) Am I eligible for ILR in Feb 2014?
3) Do I need to give any evidence as I was employed in a company in India
in 2009 and came onsite for a project assignment and came for another
project in Oct 2009?
4) Does the 180 days rule apply for each year or the total absences in 5
years?

That was a very rude reply. I know I can get the answer if I pay for it.
I was under the impression that this forum is to help people who have any confusion.

I have read the links but I don't think my case is that straight forward considering the number of days gap I have and not sure do I still need to give any evidence.


Can any other experts please reply.

I don't see any rudeness in D4109125 post. The guru is merely pointing you to the relevant FAQs

Your queries are general repetetive questions and the experts cannot repeat the same answers to each and every post on this forum. Hence the FAQ section.

You should appreciate the fact the expert members are taking their time out of their busy day to day activities to keep this forum active.
