ILR Continous period query

Hi all,

I have a bit complex query regarding calculating continuous period for ILR. Please check the details below

Entry Clearance date: September 2008
Date first entered: February 2009
Returned to home country: May 2009
Entered UK again in: May 2010 and residing continuously since May 2010.

Can I apply for ILR in December 2014 considering continuous period as
December 2014- December 2013
December 2013- December 2012
December 2012- December 2011
December 2011- December 2010
December 2010- December 2009 and
assuming I was away for 150 days(5 months) in the 12 consecutive months of year 1.

Or I will only be eligible for ILR in May 2015?

Thanks MindtheGap. The guidance doesn't have specific info if I can exclude the first six months as I have entered UK left and re-entered again.

As you have crossed 180 days in 2009, your continuous ILR period will begin from May 2010.

Hi Mind the Gap,

Are you sure this is the case, I really doubt it. You need not to have more than 180 days outside the UK in the last 12 consecutive months, counting backwards from the day of your application. I believe he can include 150 days outside UK in the first year and he is safe to apply in Dec


I would defer this to Seniors and Gurus though...Please someone can please reply.
