My case is as follows

Visa - tier 2 ICT granted on 2009 Sep
Landed in UK - 2009 Oct

absense as follows:
2009 oct 15 - 2010 oct 15(14 days single stretch)
2010 oct 15 2011 oct 15(21 days single stretch)
2011 oct 15 2012 oct 15(290 days single stretch)--> due to an existing severe medical reason for which treatment still continues.Proofs avaialable in the form of doctor certificate + scan report etc available.
2012 oct 15 2013 oct 15(100days single stretch+ another 30 days in another stretch)
2013 oct 15 2014 till date(35 days single stretch)

I understood from UKBA site that gap in a year cshould not go beyond 180 days.So looking for help..

Thanks Susan for the reply. My Visa is Tier 2 ICT Long term staff ,granted initially for 3 yeras and later extended.Now its valid until(03 Sep 2015) .Visa start date is 2009 Sep 09..

your case is quite complicated with gap of more than 180 days in 12 months. I think you will be fine in 2016 and that time your gap of more than 200 days will be divided in 2 years but but but there are exceptions also who go the ILR approved with gap more than 180 days.

Thanks Susan for the time.Infact I am ready to take the risk.But to strengthen, I thought of going thru a lawyer representation.Any one knows a good lawyer name ,who wont charge to the extreme,would be hepful..

Hi Simbu,

My case is somewhat similar to yours, though not exactly. I was planning to apply in Ocotber 2014 in which case my fourth year gap would be around 270 days (my wife was not keeping well and had to go back ti India for her treatment). Another option I have is to apply in May 2015 so that my gap would below 180 days.

I was ready to take the risk in Oct and approached couple of solicitors but havent got good reply. Below are the details:

- Kirsty Wilkinson, Dearson wineyard limited
- First Migration

I dont understand why are looking for lawyers. Looking at your case I believe you will require immigration solicitor that is what they are....I know couple of fiends who had complicated ILR case and these folks could help them.
