Dear all.

I would like to check few things with the experts and gurus on this forum. This place has always open my eyes but sometimes you cannot see your own mistakes until someone else cast an eye over it

My case is as below: -
I entered uk on the same date: 08/08/2007
Second year direct entry as student visa in Uk: visa valid from 08/08/2007 to 31/10/2009
Applied post study work: visa valid from 24/10/2009 to 24/10/2011
Applied tier 2 general from sponsor: visa valid from 09/12/2011 to 24/10/2014
Extension applied renew tier 2 general: visa valid from 03/10/2014 to 10/11/2017

Correct me if I am wrong, based on my timeline I came to conclusion I can apply for ILR as of 09/12/2016

Question 1: I read about the 28 days’ rule, am I eligible for that? In that case can I apply as of 11/11/2016 ?

Question 2: During my 5 years in Tier 2, I had a total of 179 days. Is that fine as per current regulation?

Question 3: My check list for my ILR application. I cannot see anything missing. Can you guys spot anything missing?
SET (O) form latest version
1 x passport
1 x biometric
2 x photos
Payment details sheet, possibly applying in person. Will assess situation
Original certificate form university
Life in uk certificate
12 months original bank statement
12 months payslips from employer
Letter from employer stating soc code, salary and foreseeable future
Photocopies of all supporting documents

Question 4: I saw on the application set(O) form page 21 section 6.1, It asks When did you (the main applicant) first enter the UK? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this application is based.
What date I need to put in there ? I went to Spain from 28/5/2011 and back to UK on 31/05/2011.
It says this application? Do I need to put the 31/05/2011 or use my Tier 2 date 09/12/2011

Thanks

Question 1:
You can apply as of 11/11/2016

Question 2:
Yes. No issues.

Question 3:
These documents are enough (Although, I would advise P60s for the last 5 years if possible would be an added advantage - Not mandatory though)

Question 4:
Tier 2 date 09/12/2011 (Since you are claiming ILR based on 5 years stay, stick to the first day you were granted Tier-2)

Only apply under SET O if you meet the earnings requirement, which is currently £35K pa. This will be proven by pay slips and the employer's letter.

Thank you guys.

I have worked the salary £35K issue too and got letter sorted

I have booked appointment PEO for the 12 November 2016

If I count backwards now :-

12 November 2016 13 November 2015
12 November 2015 13 November 2014
12 November 2014 13 November 2013
12 November 2013 13 November 2012
12 November 2012 13 November 2011

on 13 November 2011 and before, I was not on Tier 2, I was still on PSW. I went on Tier 2 General 09/12/2011. Is that still allowed for a ILR ?

Many Thanks

You may apply for ILR no sooner than 28 days prior to the completion of your qualifying period.

Hello All.

So it is still the 11 November 2016 I am eligible then ? 09-12-2011 + 5 years = 09-12-2016 - 28 days = 11 November 2016 ?

Cheers
