Hello moderators

I currently hold BC having previously been on ILR via the Tier 1 route. My wife has been on my dependant visa since Sept 2012.

Believe she will be eligible for ILR via the 5 year route in Sept of this year. As such, should she apply for ILR as a spouse of a british citizen or the normal 5 year route?

Could you advise the relevant form?

There isn't any difference. As the spouse of a BC she still needs 5 years of residence before qualifying for ILR.

If she holds a PBS Dependent visa (and has NOT changed to FLR(M) when you got ILR/BC), she can ONLY apply for ILR based on PBS route using form Set(O).

To further enquire on this topic, is there a need to supply bank statements and corresponding payslips as its a straight forward 5 year route ILR?
