EEA2...I think? Help!

Hello there,

A brief synopsis;

Me = Dual passport holder - Australian (w/ active Tier 5 visa) + Hungarian
Unmarried Partner = Australian (w/ active Tier 5 visa expiring in September 2012)

We are both living in London.

We have been together for 2 years (1.5 yrs London, 0.5 Australia). The 0.5 we don't have any documentation with dual names listed as we were living separately (who moves in together after a week realistically?!). She then stayed with me during the first 3 months after she arrived in London (I arrived 1 month earlier than her). Her name was not on anything. We are looking at following the EEA route for unmarried partners (residence doc).

1. Firstly, is this the right type of visa method for her given our situation?
2. Will this give her the ability to work too? She is currently working.
3. She currently has shares, and is employed via my UK LTD company. I can provide evidence of this. Will I need to, to support the working/stability component of her/us?
4. She is currently on a T5 visa. When can we apply for the EEA method? Will they reject our application if there is still time left on the T5?
5. Does a joint bank account add much weight?
6. We have tonne's of photos, e-mails etc. Does this add much weight?
7. Immigration advisers - I'm yet to find a decent one. I'm still waiting for about 5 separate call backs actually. Are they worth what they do? Are they necessary?
8. I keep on seeing a 'UK Unmarried Visa'. Is this different to an EEA Unmarried Visa (i.e. residence card).

Any help would be great.

if you want to apply for EEA rules it's really clear, you have to be together 2 years together and have to proof that.
For unmarried partners: proof that you are in a durable relationship. Generally this is proof that
you have been in a subsisting relationship for two years or more, such as joint bank or building
society statements, joint tenancy agreements, council tax bills or evidence that you are both paying utility bills at the property at which you reside.
1. After 2 years, yes.
2. Yes. She can work or open her business.
3. You have to be exercising Treaty rights in the UK as
• worker
•self-employed
• Student
• Economically self-sufficient (including retired
people)
• Jobseeker
• Incapacitated
4. After 2 years you can apply even there still time left on the T5.
5. You can added as a proof of relationship.
6. Joint bank account should be enough. You need more council tax, joint tenancy agreement etc.
7. EEA rules are really straightforward as long as your case is not complicate i wouldn't really recommend.
8. UK and EEA laws are totally different.
