TIER 1 extension

Hello Everyone
I got my tier 1 extension in Feb 2023 and now planing to apply for the ILR in next year in Sep 2024. Please can you share your views on below point.

1) The 5 year requirement under Tier 1 category will be met in Sep 2024 so am I eligible to apply for the extension or I need to wait till Jan 2025 as my visa is valid till Feb 2025

2) One of the old employee is still on the payroll and hopefully will remain with my company when I will be applying for ILR. I used his job role for the earlier extension so do I need to create another job or his 12 months period after the extension can be used to satisfy the job requirement.

3) The two job roles for 12 month period needs to be within the 24 months extension period or just before the ILR application.

4) I have hired another employee in Aug 2023 so by Sep 2024 will these two job roles will satisfy the job creation requirement or do I need to hire 1 more employee.

1) Yes you can apply once you have completed the 5 year requirement. There is no need to wait for the end date of your extension.
2) As long as the employee/role has lasted for 12 month after Feb 2023, you can use that for one of the jobs
3) The two 12 month period has to have been completed when you apply for ILR
4) From what you have so far, you don't need to hire another

Regarding the point number 3, So in case the employee will leave in April 2024 so will his post be counted for complete 12 months or his post also needs to be maintained till Sep 2024 when I will be applying.

Below is the hypothetic scenario

Employee 1:- March 2023 to April 2024 (Old employee)

Employee 2:- September 2023 to September 2024

I will be applying for PR in Sep 2024.
