UK Settlement Visa (SET F) - HELP!

UK Settlement Visa (SET F) - HELP!

Hi guys,

just wondering if you would be able to give me some advice please,

my girlfriend is Turkish, and has recently returned to Turkey. She had an au pair visa to stay in the UK for two years. As this ran out, she tried (unsuccessfully) to apply for another visa (i think it was one which would allow her to be a nanny/baby sitter). She was refused on two occasions.
The problems were predominantly with finance, and a bank account, I know they have to be in perfect order.

Now she has returned to Turkey, as mentioned. Her situation is rather complicated. Unfortunately, very sadly both her parents died when she was in younger in Turkey. She has two sisters in the UK, both have their visa's sorted. One is married, and the other was under 18 at the time she applied for a settlement visa, so i believe you get special dispensation or something.

Therefore, she is looking to apply for a settlement visa in the UK, to return to the UK permanently. She is going to save up money. I believe she will be applying for the settlement visa (set f), which is the one where you are dependent on a family relative. As she has no one but her grandma in turkey, who, as it happens is very ill.

I was just wondering if you have any advice? do you think her visa request would be successful? as you can probably imagine its a very difficult situation and she is very unfortunate.

Is the sister in the UK (who will sponsor the application) a British citizen / settled person?

Unless she is (either), she cannot sponsor the person in question.
But if she is, then see also Older dependent relatives.

yes, i can confirm that her older sister is now a British Citizen,

so i take it she can apply then?

i know it would be hard for you to say, but what do you think of her chances?

do you have any advice/tips etc?

She may apply for a settlement visa (not SET(F)), as she is not currently in the UK.

which type of settlement visa then?

but surely it would be one that is dependent on a family member, because that's her case

does this damage her chance of success?

I'm a bit confused

follow the links in vinny's post above for the type of settlement visa she needs to apply for.

it will be very difficult for her to meet these requirements as she has to show dependency as well as compelling compassionate circumstances as she is over 18 but not elderly.

thanks for your kind response greenie, just as i thought, its going to be very difficult. I will follow those links.

her situation could be described as very compassionate, but its going to be very hard proving it

have you got any advice/ tips for producing a case?
