UK Depended Visa for child rejected - help pleaseeee

Hi,

My wife had applied for dependent visa for new born baby in VFS Chennai. She had provided all the documents. They (VFS) looked at the birth certificate and gave it back. They collected the passport and all the other supporting documents to forward to British High Commission.

After a week, the visa has been rejected, because 'no evidence to prove my son is related to me such as birth certificate... I can appeal or re-apply now.

Because of VFS, the birth certificate was not submitted. But to prove the relationship, why not they look into passport, which has father's name, mother's name?????

Can someone suggest if i can goahead for appeal? Or I have read in UKBA website, I can ask for administrative review with existing documents? Can I argue that they can look into the passport for evidence of relationship???Administrative review quicker than appeal???

Dependant applications are not subject to administrative review.

Appealing will not get you anywhere, as the responsibility is always on the applicant to provide all necessary documentary evidences - so stating that VAC staff returned the birth certificate (without any evidence to prove so) will lead nowhere.

The only acceptable evidence of parent-child relationship is the birth certificate naming the parent(s). And in absence of birth certificate, a DNA test report.

I believe, when I appeal I can provide the copy of birth certificate. So, will that solve the issue or re-apply is the only solution?

I don't expect to have a hearing for a missing document situation. So would the appeal by any quicker :? ??

I know if ECO wants to challenge the decision, they may take upto 12 weeks for preparing the appeal bundle... BUT, TYPICALLY How long would the ECO take if they are to reconsider the original decision??

Please can someone reply with any similar recent experience? I am curious to know to the timeline...

Was the visa issued/granted? I am sure in this case, there wasnt any need for a hearing and the refusal should be overturned when you appeal submitting the birth certificate.
