First of all, sorry to post this if this is covered elsewhere, however I coudnt find it here.


My wife is on 2 year spouse visa and this comes to an end in November, we have a one year old baby born in UK and i am a British citizen.

When she came i became unemployed 4 months later due to the recession, i claimed JSA for one year and was sick for one month which ended in Feb 2012. Since then i have been self employed. My wife has worked intermittently (she is allowed to on her visa) I have also been receiving child tax credit since our baby was born in June 2011. I also got housing benefit for the year duration. My questions are

How many months bank statements do i need to submit when she applies this November?

Will the fact i have been on benefits mean that she wont get her ILR? is there a definite law (or any guidance) around this? I want to get a sense of the likelihood of not getting the ILR because of this. It was no fault of my own, my sector collapsed along with some companies i consulted for going bust.

If she doesn't get it, can we apply again, when? what are the timescales?

I would be grateful for honest answers and any advice on how to rectify this for the future if there is a strong likelihood of my wife getting the ILR
