First of all, I don't think the limit applies to Tier 2 in-country extension applicants.

Regarding Tier 1: one reason why it may be difficult to cap extensions is the sheer number of people competing for the visas. In 2012, for example, the new applicants will be applying together with those who got their visas in BOTH 2009 and 2010 (because of a switch to 2 year validity). Assuming a current cap applies to all applicants (new and extension), that would be about 3 people per 1 visa (at least).

For example, how do they take care of the different earnings and educational requirements across periods? How do they deal with the fact that some extension applicants got their original visas closer to the end of the year, meaning that all the capped visas would be gone by then?

I am not saying that the Government will not cap extensions. However, if they decide to go ahead with this, that would be a logistical nightmare, with huge human rights implications.

*UPDATE* MAC consultation document also mentioned putting dependents of Tier 1 migrants under the cap, so the reality can be even worse.

How do they deal with the fact that some extension applicant

Post by Parz » Tue Jul 20, 2010 10:41 am

Valid Point.
However, the UKBA is looking at releasing visa's in a staggered phase, each month. So it will not strictly be in FIFO basis.
i.e All the visa quota will not get exhausted at the begininning of the year.

However, they also plan to roll over the unsuccesful applicants to the next pool, which will effectively reduce the quota for the new/extension applicant. So effectively, an applicant who has to renew his visa later in the year (given that you can renew only within two months of the expiry date) stands at a disadvantage.

Definitely, this mechanism is un workable. I am hoping they see these practical points.
Again - I know someone was keen to send a note to the relevant bodies. Please can this point be mentioned.

Lets hope so. MAC recommendations usually tend be accepted as it is. The situation this time is a bit different due to change in the Government.

The annual cap is expected to be unveiled later this month and the Migration Advisory Committee will publish its recommendations this week.

Sounds too good to be true. I am sure they have something else planned post 2011.

Yes. I think there will be speed breakers on the road ahaead.

''The MAC also advised that the Government should raise the threshold for earnings and qualifications. They even suggested that migrants may need to be stripped of their right to settle in the UK in future if immigration numbers are to be reduced''

can you please shed some more light on the following :

Page 226 point 9.19

The arguments for and against
limiting extensions are finely
balanced. However, by definition,
successful extenders under Tiers
1 and 2 have UK labour market
experience in a skilled or wellpaid
job. Furthermore, limiting
extensions adds complexity to the
system. Finally, we are reluctant
to suggest retrospective changes
for migrants already in the UK
and, if extensions are limited to
new migrants only, this will reduce
the ability, in the short term, of
limits on Tiers 1 and 2 to reduce
net migration. This is because
changing the eligibility of new
migrants to extend or switch will
only have an impact on outflows
when their leave to remain expires
in 2 to 3 years’ time. We therefore
exclude extensions from the
required limits we set out
for 2011/12.

As usual, with UKBI's confusing word game has left me stranded.

Thanks and Regards,
KP

Message to the Moderator:
Is there another thread, discussing implications of the new rules by the govt yesterday.

Also, of going through the whole speech, I gather that Tier 1 has now stopped. The questions I have are:
1) Do we know if it effects/do not effect Tier 1 extensions
2) What is the implications of Tier 1 stay for 5 years and then into ILR..Has there been any change in that.
