|
|
Hello all,
Our family (myself, wife and two minor children) have ILR status for the last 6 months. Can we legally claim Child Benefits from HMRC without breaching conditions of our resident permit? Would this adversely impact any future British Citizenship application?
Regards,
Omar |

You are absolutely entitled to claim benefits. You're no longer subject to Immigration control so this won't affect a BC application.
Your Child Benefit claim should be back-dated by the way. |

Thanks for confirming!

I would like to ask same question but with situation -
Me and MyWife were granted ILR last week.
My 2 yr old uk born son is entitled for British citizenship hence I am in process of applying or bc via MN1
Can I claim benefits for my SON right now (on basis of my ILR and before his BC/british passport is received). _________________ cheers

Thanks Greenie for quick reply,
Sorry for not explaining the scenario clearly.
The differece between mine and oqureshi's story is that I have not applied ILR for my SON. I am planning to apply for his MN1 directly (and then British passport) which might take another 3-4 months itself. Can I claim for child benefits in this mean time because I have been granted with ILR but my SON is with NO VISA. _________________ cheers

It is not your son claiming the benefits it is you so it is your entitlement that is
matters. |
