Need your advice please; I think I am eligible for ILR from Feb 2014. I have an absence of 23 days over the 180 days rule in one of the past 5 years due to my father-in-law’s serious illness and am considering applying for ILR on compassionate grounds for the absence of the 23 days.
Background: I came to UK on work permit in 2009 & applied for Tier 1 while I was here. I have extended my Tier-1 once so far and my current visa is due to expire in June 2014.
During 2009 & 2010 I was employed with an Indian based organization and was here in UK on deputation and was getting paid salary in India. However since Dec 2010 till date have been employed in UK and am receiving UK salary.
Request your suggestions and guidance with the following:
1.For any absence up to 180 days am I supposed to provide any documentation/explanation for being absent from UK? I was working in India for an offshore project for 203 days & 137 days between 2009 & 2010 respectively.
2.During my absence of 203 continuous days, my father-in-law was bed-ridden due to serious illness & was hospitalized several times during that period. Since I was caring for him I had to delay my entry into UK for some period which resulted in me spending 23 days in excess to the 180 days rule. Please suggest if this absence of 23 days above and over the excess of 180 days can be considered for application of ILR under compassionate grounds.
3.Also could you suggest the list of documents required to support the compassionate grounds.
