Retain rights of residence as EEA family member

Post by jrakhila » Thu Mar 06, 2014 9:58 am

Dear friends,

My sister is married to EEA national from Aug 2008, she has PR already since Nov 2013.

I am on residence card since Oct, 2011, and in 2,5 years I should apply for PR too as an extended family member.

However, my sister is going to divorce her husband this year. Would this affect my case and I retain rights?

Can I still apply for PR or not? Please please help with advice.

Thank you.

Once the RC was issued to you, you are considered a family member (not extended) for all purposes of the directive and would be able to retain your rights if your sister divorce the EEA national.
