Complex case - have gaps, will aggregating absences help

Post by vkumarkulkarni » Wed Apr 20, 2016 12:05 pm

Hi,

Will aggregating the excess absences help in my case:

I have one gap of 180 days and a larger gap of more than 180 days in an entire year.
As I was relocated to multiple countires on project assignments. I have returned back to UK last year. If I aggregate the absence, spend time for more than the gaps I currently have, will it help? Or I need to wait for 5 yrs :(.
Is there any possibility if I can apply for ILR either after aggregating excess absence? Kindly help and advice. Sharing the year and gaps.

UK ENTER DATE UK LEFT DATE Year in which gap exist No of days gap

18-Apr-07 17-Jun-07 2007 180

2009 182
30-Sep-09 16-Jun-13 2014 365
10-Oct-15 in UK now 2015 312

Cheers,
Vinzee

You have posted in a manner that assumes that every immigrant in this country belongs to the same immigration category as you therefore there is only a single rule regarding "absences" and that applies to every immigrant!

When asking a query, post fundamental information about your immigration history - for anyone to help answer your queries.

Start here - FAQs for ILR - Tier 1G/Tier 2/WP/HSMP - Read before posting

Only the following words did - "Now Tier 2 General Dependant from Jan 2016"

Given that you are now in UK as a PBS dependant the only route to settlement for you (in your own right) is "long residence" - subject to you meeting the specified requirements at the time of such application. Ignore reading through the information in the link above and read this guidance instead.

Alternatively, you may be eligible for settlement after spending 5 years in UK as a PBS dependant of your Tier 2 migrant spouse (no earlier than Jan 2021).

Tried to make it more clear...

Will aggregating the excess absences help in my case:
Is there any possibility if I can apply for ILR either after aggregating excess absence? Can I go for 10 yr long period which will either be next year or in 2018.
Kindly help and advice. Sharing the year and gaps.

Read the guidance!

Provided you keep your absences in check (within permissible limits) from now on, ILR via LR route - 2025/2026.
or
ILR via PBS dependant route - 2021

Take your pick!
