Am i in trouble?

I hold ILR and wife is on student visa. We have a 15 months old son.

We are not legally married via COA route.. Long story ( Browse my posts for more info but hope John would know )

I applied for WTC and CTC under my name. On the form, it asked if your partner was subject to immigration control. I was advised to tick NO so everything went smooth and for 4 months i received everything i was entitled to.

I met this benefit advisor and explained him this situation. He advised me to write a letter to CTC office and tell them your partner is subject to immigration control. I did what he told me to.

Now i have received a letter from them asking for my passport, HO ref for both of us.

Problem is, HO does not know that my wife is married to me and we have a child and her passport is with HO for student visa extension.

If i provided CTC office her HO ref no, they would enquire about it and it could lead us to great trouble.

What can i do at this stage? Is there any way of telling HO about the mistake we made for not mentioning in Set(S) about dependant she had?

Please advice me as i have been sleepless thinking all this.
