Accommodation requirements and Licence to Occupy room (12 month licence)

Post by Jackis21 » Tue Jan 28, 2025 2:48 pm

Hi!

Can someone help me understand if this is enough. I am looking at moving away from my parents at the moment into a place I can move my foreign spouse into with me (we're married just need to get the legal process sorted to get him over here)

I have been offered a place with a 12 month licence to occupy, this is a large double on suite room, with Spam (effectively a studio flat by size and what's included). The licence covered 2 tenants.

Is this enough to satisfy the accommodation requirements. It's a full private room, that I will have the licence to occupy.

Hope this is enough details. Thanks in advance for replies and feedback.

Can't answer your question, but what licence is it you have for occupying the accomodation?
One normally signs a rental agreement with the landlord or agency.

Its this:

We offer 12-month licences where you can give a week's notice at any time, if you are still here at the end of the 12 months we just renew. I have double rooms available at X to X a week, this is all in other than the TV license and the electric. You must be able to pass a credit check and supply references.

So I will be renting a room, (like a studio) it has an on suite bathroom, Its a double room, and a Spam connected to it, with fridge/hob/microwave etc.

I'm just not sure how accepting this would maybe cause issues with the spouse visa we are hoping to start this year. Its a large room, well within my budget, and allows me a large chunk of savings a month.

Your description sounds to me like it is a holiday/caravan park house. And generally there are limits on how long/how many days in the year you can live there. Also, they will likely be shut for a certain number of days/months in the year, typically 2 to 4 months over winter.

Essentially, because they are holiday lets, they claim a council tax exemption, which would be violated if you exceed living there a certain number of days.

Check with them if there is any limit on the number of days you can stay there and whether there are any periods of the year when they are shut, before you enter into an agreement with them.

You may find the information helpful in the link below, from the charity Shelter.

https://england.shelter.org.uk/professi ... 20periodic.

It would also be wise to read the advice on how to recognise a sham licence agreement.

https://england.shelter.org.uk/professi ... agreements

If your spouse is joining you, I believe you will need a joint licence. You will be able to access information on this in the first link.
