BRITISH CITIZEN MARRIED TO EU NATIONAL RULES

Post by D8NBW » Sun Jan 21, 2024 10:44 am

Hello looking for some advice (Sorry if I have posted in the wrong forum Im new to this)
I am a British citizen and married to my EU citizen wife we are looking to retire in the next 2 years
and tour around Europe in our motorhome for extended periods of time up to 8 months at a time

My question is as my wife has an EU passport I believe I am able to travel for more than 90 days without returning to the UK ?

We will mainly staying in Spain / Portugal / Italy (Schengen areas) so do I need to report my arrival in said countries when I intend to stay in them for longer periods of time just unsure of how it works ?

Thank you

Hi,

As an EU family member from a third country, you are allowed to be in EU unlimited. The 90/180days period doesn't apply.

If you wish to stay in any EU country for longer than 3 months, you and your EU spouse have to report your stay to the relevant authorities. Then you the non EU will apply for Residence card for family member of Union Citizen aka EU residence card. Your wife has to work first or you have to have sufficient funds because you will need to show proof of income. After you have the Residence card your wife can stop working and you can decide to work alone until you both are on pension then you use the pension funds as income.

There is a British national with a similar issue but for Germany. It's similar steps anyway.

Thank you that makes senses we will both be retired so no need to work so as I understand it we chose to stay for example in Spain I need to notify the authorities that I am there if staying over 90 days and that I am the spouse of EU citizen then provide evidence that we are economically viable from savings, pension income etc

Many thanks for your help :)
