Hello,

My name is Deepak and would be grateful for some advice on the following query(which in some ways, is unique)

My daughter was born a few weeks ago in UK and is going to India in 2 weeks. I have registered her name in the council and embassy and am waiting for her Indian passport.

I am on my HSMP tier 1 visa(originally HSMP) and my wife is my dependant. My wife and daughter are going to India for few months. My wife will be back in time to apply for ILR in July 2011 but my baby will stay back in India for a few months after that(for family circumstances).

I have thought of obtaining HSMP tier 1 dependant visa for my daughter but because she'll be coming back after July 2011(when I apply for ILR), I presume her HSMP dependant visa would not be valid as I would have changed to ILR.

Therefore, to travel back to UK, baby would need some visa - should it be a ILE OR is it possible apply for my daughters British passport in India itself at that point(considering I will be on ILR and baby would have been born in UK) OR would I have to apply for settlement visa for her from India -I am not sure of the implications of the subsequent difficulties of converting from settlement visa to citizenship.

I would be grateful if any of the members would give some guidance or if someone could highlight their experiences(if they've been in similar situation), so that many of us could benefit.

After you get ILR your daughter will be entitled to be registerd as British citizen so you can apply for her registration and then her British passport without applying for any visa regardless of the fact that she will be out of the UK at the time

Infact, I have been calling up the UK embassy in India(Delhi) for the last few days. Today was my lucky day since someone actually answered but the gentleman suggested I can still apply for HSMP dependant visa(although I would be on ILR then!!) I didn't agree with that and asked about directly applying for a UK passport, to which he transferred my call but there was no one in the passport section !!.
Just out of curiosity, have you been in a similar situation Guru or do you know some one who has?
Any idea as to how difficult it is to obtain a UK passport from India and whether we would need to apply for a Indian visa to stay there obtaining the passport.

I am not from India so cannot comment about any particular processes there.

i did the process whilst here in the UK, my child was born in UK b4 i got ILR, i then applied for registration which took about 2 weeks and once i got the registration certificate i applied for passport which took another 2 weeks

with regards to the British high commission and passport application, you will need to establish citizenship before you can apply for passport
