Adult Dependant grant - UK student

Hi guys, quick question:

I am the sponsor (UK citizen) and my spouse received his leave to remain a few months back. I am a full-time student and I have applied for student finance maintenance. As part of my application, I applied for an "Adult dependant grant" and was granted 3,500GBP. To meet the requirements my partner had to earn less than 4000GBP per year, which he does.

Am I allowed to apply for an Adult dependant grant as part of my student finance application? My spouse's visa requirements state "no access to public funds", does this include any application to public funds by the sponsor?

Will this put the visa at risk?
