Claiming Universal Credit with partner on spouse visa

Hello

I am British and my 3 children are all British. My partner is, however, on spouse visa

I have recently lost my job and my partner isn’t working. Without compromising my partner’s ILR and citizenship application, can I put in a claim for Universal credit? Only at the single rate and no housing or CTR at all. Please advise, thank you

Yes. You apply for UC as a couple as your earnings/savings/capital are linked and then you make sure that you only get the single rate. From what others have said on here, they get notice that their NRPF partner cannot have UC (extra payments through your joint claim).

1. Definition of a couple

The Department for Work and Pensions counts 2 people as being in a couple if they live in the same household and are:

married to each other
civil partners of each other
living together as if they were married

2. Claiming Universal Credit

If you are part of a couple you and your partner will need to make a joint claim for Universal Credit.

You begin by creating a Universal Credit online account each. The first person to create their account will be given a partner code, which will be displayed on screen.

This code will need to be input by your partner when they register for their Universal Credit online account. This ensures the accounts are joined together and you are correctly claiming as a couple.

Once you’ve created your account a claim can be made for Universal Credit. You’ll have 28 days from creating the account to make a claim. You should aim to complete the application as soon as possible to get your claim started.

If 28 days pass and a claim is not made you’ll need to register for an online account again.

If one of you isn’t eligible, their capital and income may still be taken into account.

UC doesn't give any payments towards a mortgage.

UC might pay some towards the rent if you are renting, under the UC Housing Element (it rarely covers all the rent); I assume you are talking about the medium.co article about having a NRPF partner, in this sticky? claiming-benefits/universal-credit-clai ... 02126.html

There is a two child limit for UC payments, unless there is an exemption.

Hi thank you very much for your reply.

Yes I have read the medium.co article as well as the turntous one and can see that complications arise mainly due to:

1. The housing UC element, if that increases due to partner presence

2. Council tax reduction, if awarded at the single rate, this would tend to increase as single person discount of 25% would be awarded thus increasing CTR due to partner presence .

Because of the above, we have made a claim with no housing costs claimed. So in effect, it’s just getting my single allowance and allowance for first and second child which apparently will eliminate all risks above. Nothing for my partner and no risk of claim increasing due to partner.

We are still very double minded about claiming as my partner’s name is still mentioned on the claim and it technically it could be argued that she did put in a claim even though she will get 0. But it’s a difficult time as we are both not working and are running out of money

Why would your wife’s presence increase the housing element on UC? You cannot decide not to have the housing element if you are renting then that needs to be put on your claim, otherwise you are submitting a potentially fraudulent claim. The question asks if you rent.
