Council House while Pregnant Spouse on Visa

Dear all,

My situation is that I have ILR and my wife is pregnant and on a spouse visa. The place where we live is a shared accommodation and we will be asked to leave either before she gives birth or soon after (all working professionals will not want a crying baby to stay for sure).
I am currently a student at the University and have a very limited source of income (though, having worked for 8 years as a self employed always paid my taxes).

The question is, when we have to move out can I claim council housing?. Shall I mention only my own name on the application (as a single father) or both my wife's and mine (she cannot claim public funds)?
Another question is the timing: can I claim the housing when she is pregnant (she has no access to public funds) or only after the baby has been born (he will have British citizenship and I have ILR)?

At present you can only be considered as single when being provided with council accommodation. However you should advise the local authority that your wife is under Immigration control but you are soon expecting a baby. You then count as a single person with one child. You will also be entitled to claim child benefit in your name and if your earnings aren't too high, Child Tax Credit in joint names.

I don't see why not but you may not be allocated a council house until the baby has been born. It depends on how flexible the local authority are and whether there is a shortage of accommodation in the area.

It's good news in any case.

I've been really anxious. Thought would get a reply like "You cannot apply as your wife's got only a spouse visa".
Would not know what to do in that case.

Just make sure that the housing is allocated to you and then includes you child once he or she arrives.

What does it mean "housing is allocated to me"? Sorry if it sounds silly. I really do not know anything on the topic.

Allocated to you = qualified to entitlement as a single person with a child expected. They can't count you as a couple. You should ensure you show them proof that you have to move out of your current accommodation.

"..make sure that the housing is allocated to you.." Shall I pay attention that the housing is allocated only to me/my child when he is born?... that my wife is not included in the application (as it will jeopardise her ILR application and make my housing claim illegal)?

And a follow-up question.. If a place (if..) is provided, can my wife stay with us without any adverse consequences ?

That's correct. Your wife can stay with you but she won't be considered when the local authority are awarding 'points' for priority regarding property allocation.

Just a bit of clarification. To mention my wife when applying (that she is not entitled to public funds) and to check that she is not included in the housing allocation.
So, she will be on the application but not in the decision part.
In case her name is included in the entitlement part to bring it to the attention of the officer (I guess) in charge.
