Delayed Decision Letter and BRP for Newborn Dependent in Asylum Case.

Post by Kayla1890 » Tue Jun 25, 2024 12:54 am

Hi guys!

I hope this message finds you well.

I am seeking advice regarding my asylum case. In 2021, I claimed asylum, and my husband was included as a dependent in my application. While we were waiting for our interview, I got pregnant, and in August 2023, we welcomed our sweet baby. I informed Migrant Help about the birth, and they confirmed that they would add him to my case as my dependent. Subsequently, I received several communications from the Home Office confirming that both my husband and baby were listed as my dependents.

I eventually had my asylum interview, and a few weeks later, the Home Office requested my solicitor to send them my son's birth certificate and to email a passport-sized photo of him. I was unsure why they needed this information but complied. Later, they asked if my son had the same grounds for asylum as I did, to which I responded affirmatively.

In January 2024, we received an email stating that our Biometric Residence Permits (BRPs) were on the way. While my husband and I received our BRPs, we did not receive our decision letter or my son’s BRP. Our solicitor assured us that these would arrive shortly, but it has now been several months, and we still haven't received them.

If anyone has experienced a similar situation or can offer any advice on what steps to take next, I would greatly appreciate your help.

Thank you in advance for your assistance.

Hi
I got my brp in January 2024. I got indefinite leave to remain while my husband got leave to remain. I wonder if it’s a mistake because I have reported it online that I should have been granted leave to remain and HO acknowledged my enquiry but did nothing. What kind of leave did you get?

Well you could try to email home office using this email address enquiries@homeoffice.gov.uk but I can’t say if they will respond or not.
Otherwise what you can do is check your decision letter and see what kind of status have you been granted. I wouldn’t worry about the ‘valid till’ date because they are moving everything online and once you have your electronic BRP these mistakes will automatically be corrected.
If you haven’t received your decision letter you could use SARU and request a copy of your decision letter. Here’s the link where you can find more information about SARU
https://www.gov.uk/government/publicati ... mmigration
Good luck with that and let me know if there’s any update.
