Did you meet the knowledge of English Yes requirement? HELP!

Post by kpmp » Wed May 18, 2022 11:59 pm

Hello,

I completed my online AN1 application this week and I am a little worried about something in the application that I had perceived in a different way.

I am applying via the EU Settlement route as I have received ILR by being fully EU Settled.

The application has the question: Did you meet the knowledge of English requirement as part of an indefinite leave application made on or after 28 October 2013?
I perceived this question as if I meet the requirements of the English language for the application and therefore I selected Yes. However, I have not submitted another ILR application that required an English language certificate. I only have the EU Settlement scheme IRL which did not have an English language requirement.

Further down in the application it asks: Will you use your Indefinite Leave to Remain (ILR), including ILR granted under the EU Settlement Scheme, to apply for British Citizenship?
I selected Yes and provided the date the ILR was granted.

Continuing in the application it asks if I have made any previous UK immigration applications in the UK or abroad in which I selected No.

Finally it asked some questions about the English language requirement:
Do you have a degree that was taught in English?: Yes
Country: United Kingdom of Great Britain and Northern Ireland
What will you use to prove your degree taught in English?: Degree certificate
Do you have a previous visa, entry clearance or leave to remain where you had to prove your knowledge of English: No

Will this be an issue with my application? This has made me incredibly upset and I am starting to lose my mind as I have made so much effort to gather everything and proceed with the application. It seems like I am being very clear in the section where they asked about the language that I did not have to prove it before.

Does anyone have any experiences with that?

Many thanks in advance for your help.

I feel like this is something that I need to explain in a cover letter and attach it along with the rest of the documents to avoid confusion.

However, any feedback is welcome :)

Not sure what the issue is ... just use your UK degree certificate as proof of English. No nedd to explain. Caseworkers know the rules.
EU Settled Status does not require proof of English. You should have answered "NO" to the ILR question because that relates to UK ILR, not settled status.
This is just my opinion as a member of this forum and does not constitute immigration advice.
Please do not send me private messages asking for advice.

Hey thanks for your reply.

The confusion on my side was with the questions.
So I answered "YES" to that question "Did you meet the knowledge of English requirement as part of an indefinite leave application made on or after 28 October 2013?" as you pointed out I should have answered "NO". I will of course upload the degree I have from a English-taught course within the UK.

And later on I answered "NO" on whether I had made any other immigration applications in the UK or elsewhere before. The EU Settled Status application was in fact an immigration application and I should have selected "YES", but I did not, on the basis that I had declared elsewhere that I have ILR under the Settlement scheme. For this reason I will also upload the EU Settlement scheme outcome letter to show that I've done that and they could search internally to find the records as the letter has the date they granted the leave (which I also provided in the application) and a reference number.

All the requirements of eligibility are met of course and I will be providing the relevant documentation.
