Domestic violence

Good day all, my friend was granted LTR on the 10 year private life route. In the time that it had taken for her application to be considered she had her first child. She now has 2 children however, she had to flee her partner after continued abuse and she feared for her life. She has been moved out of the area by the council and she is now being supported by them. This occurred in August last year.

Prior to the separation she had notified the Home Office that she was living with her partner and they were aware that she would be applying as the partner of a British citizen when her application was due for renewal. They had applied for a fee waiver and his finances was considered as a part of the process.

Her children are aged 3 and 2 years and they are British Citizens. They both live with her.

Is it possible for her to apply for indefinite LTR as a result of the domestic violence that she endured or would she need to apply for further leave to remain as a parent?

The last incident was reported to the police and she has a CAD number. She has also been supported by a charity that deals with victims of DV.

A person with leave under private life route will not benefit from DV concession rules
