Place of birth query

Post by Hihey » Sun Mar 31, 2024 12:14 pm

I am a British citizen who sought asylum in the UK in the late 90s to escape the Taliban regime in Afghanistan. At the time of my arrival, due to the chaotic situation of war, I had no official documents to verify my personal information, including my date of birth and place of birth. Thus, I believed I was born in Kabul, a city in Afghanistan.

However, recent developments have led me to discover that I was actually born in Peshawar, a city in Pakistan. This realisation came to light only recently, prompted by the passing of my step mother. It's important to note that during the war, many Afghans, including my family, migrated to Pakistan in search of safety and better opportunities.

Currently, my British nationality and passport both state Kabul as my place of birth, which does not accurately reflect my background. Therefore, I am reaching out to inquire about the possibility of correcting my place of birth on my British nationality and passport to Peshawar, Pakistan.

I have already contacted the Pakistan Union Council, the authority responsible for issuing birth certificates, and can obtain the required documentation confirming my birth in Peshawar.

Could you kindly advise me on the steps I need to take to initiate this correction process?

I have noted the following link on Gov UK
https://www.gov.uk/government/publicati ... ertificate but I am struggling with the following question within the form "Explain why you have not requested an amendment of your certificate until now". Is my reason reasonable?

Not something we see here regularly.
If you want this corrected then you need to explain all the circumstances, and answer every question. Attach documents which support your statement.
Best not to pre-judge how your application might be viewed. Stick with the facts - on which a decision will be made.
You need the new certificate and there’s no choice really.
This is just my opinion as a member of this forum and does not constitute immigration advice.
Please do not send me private messages asking for advice.

Sometimes it is better to let sleeping dogs lay. There are risks in what you propose. Straight away your whole history of your asylum journey gets questioned. The who, the how and why behind your asylum claim can be reviewed to your detriment. Someone has lied and gained from that lie, it may not have been you who submitted the asylum application but you are the beneficiary of the lie.
Some questions to ask yourself.
How old were you when you came to the U.K.
Is the age above your real age or a now known to be a false age?
You suggest you now are aware of your Pakistani identity - so it would appear you now know where you were born and brought up. Obviously depending on the actual real age you came to the U.K. will impact on the whole story you or your family members lied to the Home Office about.
Did you come alone or with family members.
Have other family members claimed asylum?
How many close relatives are living in the U.K.
if there are other family members they could be dragged into the review too - so you have to think about the impact on others too

You are not going to simply get to change your place of birth without having to address the above - particularly if you came as an unaccompanied minor and were in fact over 18 when you arrived. That is a sure fire way of getting yourself in a mountain of questions and challenges.

Hence unless there is a particular reason you absolutely need to reclaim your Pakistani heritage then it may not be in your best interests to pursue the change.
