switching aupair visa to tier2

Hi ,

we would like to change our visa .Already my wife has a aupair visa . we found a job in here so we would like to switch her aupair visa to tier2 . What we must do for this ? İ quess employer must be give a job advertisement after that employer have to explain this to home office why choose the this person .


Briefly but we dont know anything about this . What we must do for to switch visa . is it the right way to apply tier 2 ? i think we cant appyly tier her visa tier 1 for to switch her visa ..

Hi,

What is the job?
Is the Job on the Shortage Occupations List?
If it isn't has the employer completed a resident labour market test?

Also what is her qualification level and what is it in?

In order to apply under T2 of the PBS your wife will need to apply for a job that, in order to perform the job, requires the minimum qualifications set by UKBA. And that the job is either on the Shortage Occupation List or that a UK/EU citizen can't do this job. The employer will then be able to sponsor her under T2.

There are further conditions to this. Firstly the above must be met and if the job is not on the Shortage List then the employer will need to perform a resident labour market test. This will show the UKBA that a UK/EU can't do the job but that she can. If, however, the job is on the Shortage List then the employer can sponsor her. The employer will need to be a registered sponsor with the UKBA. If not then they can't sponsor her or anyone under T2 PBS.

As for the minimum qualification set by UKBA to qualify. I believe your wife will need to be qualified to a minimum of NVQ level in order to gain points towards this category. So, this job will need potential employees to have an NVQ or above.

Au pair is one of the strange roles that are not covered by PBS. The rules in regards au pairs remain the same and will contiue to do so. You can not change to tier 2.

Yes it is changing to T5 sub category Youth Mobility Workers. The current Au Pair route will be deleted on 27th November and Au Pairs will need to apply under T5 YMW. Although this sub category will remain points free. That will just be the new name.

OP tylerdurden whilst a switch over, as such, is not possible an application for T2 is provided the conditions set out are met.

It is interesting that you say your wife is an au-pair as people in that category have to be single. I do hope no dedception was used in the application.
