Home office challenge to allowed appeal

Post by TBC711 » Tue Jun 10, 2014 9:42 am

Hi Guys,
After some advice here. My Thai wife of 7 years had her appeal against refusal of a settlement visa allowed by the 1st tier Tribunal on 25th Feb 2014. We were told it could take up to 12 weeks for the visa to be issued. It is now 15 weeks and we have heard nothing. I mailed the court and they responded that they had sent their determination to the British embassy in Bangkok 3 weeks ago. I have been trying to contact the Embassy and the Home office for over a month and get all no response at all. i had also contacted my MP an asked that he contact the Home office. He got back to me saying the Home office had challenged the allowed appeal. No one has has had the decency to contact me and tell me about this challenged. So any advice please. Can the home office do this and not tell me? We waited 10 months for our original appeal. Any idea as to how long we might need to wait for the Upper tier hearing and can i attend? Why have the court told me that they have sent their determination to the Embassy if there is a challenge? I am gutted that my wife and i have waited 4 months expecting the call letter any day only to find we are back at square one again.
