IHS Fee refund

Hi All,

I am on skilled worker visa with my current employer. They had done skilled worker visa for 5 years in 2022. I have now resigned because I got an offer from a different employer and they have sponsored my skilled worker visa.

My current employer has a clawback clause which is 50% of the total expenses that they had incurred for sponsoring my visa.

They are considering the IHS Fee as well for this. Can any one please let me know if the IHS Fee can be refunded as I am switching to a different employer within UK and my IHS Fee has been paid for the next 3 years as well.

My current employer is saying since I have resigned voluntarily they can't process the IHS refund , it can only be refunded when they withdraw my visa.

Refunds
You’ll get a full immigration health surcharge (IHS) refund if:

you paid the IHS twice for the same visa application
your visa application is refused
you withdraw your visa application before a decision is made
You’ll get a partial IHS refund if your visa application’s successful but:

you get less time on your visa than you asked for
any dependants on your visa application are refused a visa - you’ll only get their IHS back
you’re applying to extend or switch your visa in the UK and have paid the IHS twice for the same period
If you’ve paid twice for the same period and that period is 6 months or more, you’ll get a partial refund rounded down to the nearest 6 months. For example, if you’ve paid twice for a 15 month period, you will get a refund for 12 months of IHS.
How you’ll be refunded
If you are due a full or partial refund for these reasons, you do not have to do anything to get it. It will be paid to the account or card you paid with.

If someone else paid the IHS on your behalf, they’ll receive your refund.

Thanks for the response.

So in my case I can get the refund for the IHS Fee paid for the next 3 years. Since I am switching to a different employer with the same skilled worker visa and have paid IHS Fee.

Can you please confirm.

The refund is made pro-rated. See the guidance quoted above.
