Hi All,
I am on skilled worker visa with my current employer. They had done skilled worker visa for 5 years in 2022. I have now resigned because I got an offer from a different employer and they have sponsored my skilled worker visa.
My current employer has a clawback clause which is 50% of the total expenses that they had incurred for sponsoring my visa.
They are considering the IHS Fee as well for this. Can any one please let me know if the IHS Fee can be refunded as I am switching to a different employer within UK and my IHS Fee has been paid for the next 3 years as well.
My current employer is saying since I have resigned voluntarily they can't process the IHS refund , it can only be refunded when they withdraw my visa.
