ILR application date and biometric appointment

Post by srs07 » Sun Jan 05, 2025 9:38 pm

Hello,
I'm in need to travel for an emergency situation ,kindly advice me when I can submit ILR O skilled worker application(Tier 2 General VISA 5 year route).

Tier 2 General VISA start date: 05/02/2020
UK entry Date: 12/02/2020
VISA expiry date: 19/02/2025.

1. From which date I can submit application witn super priority?
2. From which date I can book biometric appointment?

Thanks

1. Anytime before visa expiry
2. You get 45 working days to submit your biometrics after online submission

The earliest date of ILR eligibility is within 28 days of completing your 5 years, counting from the first visa issue date. The date of application is not critical. Read: Applicants can benefit from the date of the ILR decision

Thank you zimba for your response.
Based on my VISA issue date 05/02/2020, I should be eligible for grant of ILR from 07/01/2025 ,which is 28 days prior.
Hope I can submit application and book earliest available biometric appointment from 07/01/2025. Am I right?

Where should I mention in ILR application to cover the absence period from VISA issue date and entry to UK? I dont find any right section for this period in ILR application. How caseworker can find this information to consider my qualifying period from VISA start date instead of entry date?

Thanks

You are right. Caseworkers know the rules and use your first visa issue date. You do not need to tell them about the absence at the beginning

Thank You, one question from my documents. My latest payslip salary processing date mentioned as 26th Dec, but in bank statement salary credited on 24th Dec itself. Will this be any issue/concern for ILR application?
I checked with employer, they say as shouldn't be an issue as salary to be paid on or before the date of payslip.

Thanks.

Your daughter can only apply for ilr when your wife does or once your wife has ilr.

Hi Again, Since I got ILR on tier 2 general 5 year route already, still my dependents ILR application to be SET(O) ? I need to fill only my application reference there instead of ILR status?

Request your advise whatbisbthenr8ghtbform I need to use for my dependents who are on my Tier2 General PBS dependent visa.

SET(O) it is. You do not need to provide any reference. UKVI knows your immigration history as they need to check your status before granting your dependants' ILR

For Set(O)- Skilled worked dependent ILR application, I have below questions, can you please advice?

1. Do you have any of these reference numbers for Mr(Main applicant me- already got ILR on 5 year Tier 2 general route recently)? - passport, National Insurance details are fine. For Home Office reference number -believe I need to provide the reference number of my ILR approved application. Am I right?

2. Which visa is Mr(Main applicant- me) applying for or been granted? ==>Answer Tier 2 General , I dont find Settled or ILR in the available options, as I recently got ILR. which one should I select still Tier 2 General?

3. If they have one, what is sponsor licence number?==> Now my status changed to Settled(ILR), sill need to give previous Tier 2 general sponsor details?

4. When did you first enter the UK?=> My wife got her VISA changed with in UK ,since 12/03/2020 as per BRP date. So she need to enter 12/03/2020 as entry date basing this application?

1. You do NOT need to enter any reference number
2. Their ILR will be based on your previous status as a skilled worker
3. Provide old details, it does not matter
4. Again, the date your enter has no bearing on ILR

Hello Zimba,

Based on earlier advises, started filling SET(O) form for my wife and daughter to apply for ILR. As you are aware I already received ILR in Jan 2025.

My wife PBS dependent VISA start date is 12/03/2020, she gets qualified only 12/02/2025 onwards for continuous period.

Can I submit the application today( both my dependents) and book Biometrics on or after 12th February 2025? So the date of decision would be with in 28 days of completion of continuous period ( 12/02/2025 - 12/03/2025 - 5 years) ?

or

you would advise me to submit the application on or after 12/02/2025 and bio metrics earliest after submitting application? Kindly note their current VISA expiry date is 19/02/2025.

Appreciate your advise.

Thanks

Hello,

Happy to update received settlement application successful emails for my wife and child.
Wife's eVISA updated as- Settled, but daughter's status is as "Dependent".

Can I know is there anything wrong for my daughter's status? I expected it to be updated as "settled" .

Thanks

Report the issue: https://www.gov.uk/guidance/making-sure ... -of-the-uk
If your status is not displayed or displaying incorrectly, report an error with your eVisa
Sometimes the immigration status is not updated immediately. That happens to many, it doesn't affect her current ILR status.

Hello again, Below is the response I got when raised for status correction for my daughter.

"You contacted UKVI because your eVisa shows your immigration status title as ‘Dependant’ and you believe this is incorrect/ that your status should show as settlement.

We have reviewed your case and confirmed your status is correct, based on the immigration route under which you were granted. This includes the length and conditions of your permission, such as your right to work. We are aware the status title on your eVisa may not match the status title on your BRP, however, this does not affect your immigration status. You are still able to use your eVisa to generate a share code and demonstrate your right to live and work in the UK, and to travel internationally.

Carriers will be allowed to accept BRPs which expire on or after 31 December 2024 as valid evidence of permission to travel until 31 March 2025. If you still have your BRP, it may be helpful to carry it with you when you travel even after it has expired, provided you still have valid immigration status.

You do not need to take any additional action."

It does not matter that it says dependant. As long as it says there is no limit to stay, it means they have ILR. There is nothing to fix
