ILR FOR ELDERLY PARENTS

Post by champu72 » Tue Aug 23, 2011 10:30 pm

My elderly parents(76 and 71 yrs) are visiting me in UK now after the sudden death of my brother who was 32 yrs old in India. They are at present on a tourist visa for 6 months.Since they are quite frail now,I intend to apply for Indefinite leave to remain in UK.I am their only surviving child now.We have a 3 bedroom house. My husband and I work and earn around £3000 a month. We are British citizens.we have no mortgages or debts to pay.
Please advise if there are chances of their getting a ILR.What are the major requirements for it?Any information and suggestion will be very well recieved.

If I were you I would take legal advise before doing anything! This is not an easy category (perhaps the hardest of all) and if they don`t qualify (are they indigent and have they lived on your benevolence up to now?) they will never get another visit visa after a failed settlement application. Any competent and reputable immigration professional will be able pick over the facts and finances and tell you after five minutes if their settlement application has any merit.

You say they have entered the UK as visitors. In cases like this, the requirements they may have shown for a visit visa (independance and ties to home) work in the opposite direction to those of settlement applications (dependance on the benevolence of a UK sponsor and no ties to home such as income or other relatives). You can see how difficult it all becomes and blindly applying without first checking if they are suitable candidates (and well-meaning comments on this forum are not a substitute for private professional help) would be an act of folly. Good luck!
