Working While on Fiance Visa

Post by hredderson » Sun Jul 31, 2011 5:54 pm

My question is regarding working while on the fiance visa. I am aware that once I have received my UK fiance Visa I am not allowed to work during the duration of the that visa.

I currently have the opportunity to begin working for a large international company based here in the US that also has offices in the UK. The position would be in consulting which would allow me to work 100% remotely and travel from time to time for meetings, etc.

My question is whether or not the fiance visa's working restriction is limited to work that occurs and is paid solely in the UK. So if I am employed by this company here in the US now and they allowed me to work remotely from the UK once I have moved there, would I be allowed to keep this job through the duration of my fiance visa since it is a US company and I would be paid into my US banking account? This company has told me that once I am eligible to work in the UK after my marriage, they would be happy to formally transfer me to be based out of and paid from their UK office as a UK resident/employee.

I would really like to pursue this opportunity as it is a great job and would provide job security for when I am able to work in the UK, but I do not want to do anything that may jeopardize my visa application and/or my fiance visa once I have it.

Any advice, answers, or similar experiences would be appreciated!! Thank you!

No you cannot work in the UK on a visa that does not allow you to work in the UK.

Where you are paid is not relevant, you will be working in the UK.

You are not allowed to work on a fiance visa in the UK, irrespective of whether or where you get paid for it.

My advice would be that asap after arrival, get married, apply for FLR and once this is approved, you are free to work. But until such time this happens, you are not allowed. If you do it could have serious implication for further leave to remain after your marriage.
