Am I eligible for ILR under the new route under private life?

Post by Abigal202312 » Thu May 11, 2023 12:45 pm

Hello all,
I'm hoping someone in this thread will help me with my query. My residency permit expires in early June and I'm preparing my final renewal but just found out about the early irl concession.

Background:

- Came in the UK under a visitor visa at age 10 (I'm now 29)
- Mother is British. Father doesn't live in the country
- Overstayed the visitor visa before applying for anything else
- Had several attempts to get a legal stay refused between 2005-2013
- Granted 10 year private life route in 2014 (20 years old at the time)
- successfully renewed subsequent visa and last renewal was granted in 2020 prior to the concession

My question is do You think I'll be able to be granted early ilr?
Like most people this experience has been daunting for me over the years and I can't afford a solicitor at this time. But do not want to jeopardise my application or make it more complicated - My case has always been regarded as complex by the HO and I can't use the premium service etc.

I have the forms and documents ready for the flr(fp). Will a simple statement in my cover letter asking for the case to be considered for early ilr under the concession be sufficient. I don't want to change routes or use any other forms as I'm worried I'll apply for the wrong thing.

Thanks for your help

Yes, you should be able to get ILR under Appendix Private Life, given that:

• you were first given a visa on the basis of your private life when you were aged between 18 and 24 and you met the half-life test
• you initially arrived in the UK as a child
• you have lived in the UK for at least 5 continuous years

There is NO priority visa service for applications under the private life route at all. You do NOT need a covering letter.
The correct form to apply for ILR under this route is SET(PL) and NOT FLR(FP) :!:

Apply here: https://visas-immigration.service.gov.u ... -and-other
Advice is given based on my personal research and experience only. Do NOT contact me via private message for immigration advice

Thank you so much for your reply! Will definitely be going with the SET (PL) form.
