ILR Application with 10 years long residence route

Hi team,

I am planning to apply MY ILR application (long Residence route). Have got queries related to the dates. First entry date is 10/03/2014 into UK , with this i will be completing 10 years on 10/03/2024. But i would like apply before 10th March as my existing visa is expiring. I am in the middle of my online application and thinking of submitting on 11/02/2024 ( 10/03/2024- 28) . Also thinking of choosing super priority slot on 10/02/2024 midnight 12:00 am , submitting the application by selecting super priority slot (if i get one) changes the date of submission to 11/02/2024.
Can this be valid ? do they consider application submission date as 11/02/2024 as will be submitting at midnight.
Also please confirm if we need to consider the start date as first entry date or visa start date? Asking this because one of the solicitor i consulted said that i can consider visa start date . In this case my visa start date was 05/03/2014 and calculate ILR eligibility as (05/03/2024 -28 days ) as 05/02/2024.
can you please help here.

Long residence ILR qualifying period starts from the date you ENTER the UK and not the visa start date. Whoever you 'consulted' is confused. It is only the Work visa routes that use the visa start date as the beginning of the qualifying period.

You have not stated what date your current visa expires.

If you pay at midnight or after midnight, your date of application is the 11th not the 10th!

What is your full immigration/visa history? There have been changes to the rules and certain visas no longer count towards long residence.

Thank you Char for clarifying on the dates.

Current visa is expiring on 11/02 and hence thinking on submitting on 10/02 midnight. I was on Tier 2 ICT work visa and then moved PBS dependent on Tier 4 & Graduate visa. Have checked the list of visa not considered for long residence from here -https://www.gov.uk/long-residence/eligibility
Let me know if there will be any issue with this ?

Hi ,

Just wondering if there is an option to submit the ILR application under 10 year LR route earlier and match the eligibility date with biometric date like stated in the link below for 5 year route .

There are no issues as only temporary visas break your continuous residence

So can i submit my ILR application before 11th Feb and book Biometric on or after 11/02/2024?

And also can you please advise on what is best way to submit my wife application as spouse dependant -FLRM as her existing visa (BRP) is expiring on 11/02/2024. Is there way i can submit FLRM application using application reference ? If not do i need to wait for decision on my ILR application?

Yes. Just book the Biomertcis after 11 Feb. Get the UAN of your ILR application and then apply via FLR(M) for your wife. Just add the UAN number in the additional information of the application and explain the spouse is waiting for ILR.

My son who born in UK and he is 6 year old living with us. His visa also expires with us. I read in GOV.UK , that child dont need ILR if either of the parents having ILR and can register for British Citizenship. But in our case his visa expires before my ILR decision. Can you please suggest if i can wait till my ILR decision and apply his MN1 application or i can submit his application before his visa expires (11/02) and mention my ILR application reference.
Please suggest which is correct thing to do.

His visa expiry has no effect on his entitlement to British citizenship. Just secure ILR and apply to register him using form MN1.

Hi zimba,
Thank you for all guidance and help. Its been very helpful.

I am filling FLR(M) application for my wife while my ILR application is just submitted and yet go for Biometric appointment after 11/02/2024.

I have doubt in answering one of the questions(mentioned below) about applicant's partner basis for living in the UK , in my case its me.

Do i need to select Others or Settled in the UK though i am yet to receive the decision on my ILR application.

If others is correct then what all details , i can provide in details section. Please request you to guide me on this .

Also in the next page it asks to confirm that applicant to provide the Evidence of Partner's Immigration Status in the UK. What would be Evidence in my case ?

It should be 'settled in the UK'. After all, if your ILR is not approved, FLR(M) cannot succeed. The evidence does not matter much as they see your status in their systems

After selecting option Settled in UK, it further ask to enter details of it. In my case i tried to enter my ILR Biometric date which is next week. But it is not accepting future date(logical).

Can you please suggest what date i can provide here?

What type of visa or leave did your partner use as the basis of their settlement?

Again, choose any date. It does not matter. The date on the form has no effect on your application.
