How to understand "180 days in ANY consecutive 12 month"?

Post by pengbai » Mon Jan 13, 2014 2:11 pm

Dear All

I have read some threads from this forum, and they were really helpful!

However, I do have a question regarding "ANY consecutive 12 month".

In this thread http://www.immigrationboards.com/indefi ... ml#p800217, "consecutive 12 month" was interpreted like this (I know that is an example from Home-Office):
For example, if the date of application is 11 November 2012, the consecutive periods would
be as follows:
Year 1 11 November 2012 to 10 November 2011
Year 2 11 November 2011 to 10 November 2010
Year 3 11 November 2010 to 10 November 2009
Year 4 11 November 2009 to 10 November 2008
Year 5 11 November 2008 to 10 November 2007
But, for me It seemed not right way to understand "ANY consecutive 12 month", and it should have nothing to do with the date of application. "ANY" here means nothing?

Please anyone can clarify this for me?

Kind regards
Peng

So far as absences are <180 days per each 12 month period of 5 years there shouldn't be an issue.

Thank you for the reply! That really gives me some confidence to proceed.

If I use the "valid from" date of my first T2 visa 08th Mar 2009 to count forward to 09th Mar 2014, then the leave are just fine...

09th Mar 2014 -- 08th Mar 2013 25 days
09th Mar 2013 -- 08th Mar 2012 154 days
09th Mar 2012 -- 08th Mar 2011 175 days
09th Mar 2011 -- 08th Mar 2010 23 days
09th Mar 2010 -- 08th Mar 2009 23 days

Do I still need a letter from my employer to explain why for 09th Mar 2013 -- 08th Mar 2012 and 09th Mar 2012 -- 08th Mar 2011, my leave was so much?

Thank you!

That should not be requested, contrary to the rules and guidance.
