Work while waiting for ilr decision

Post by Ahmed_1987 » Fri Apr 28, 2023 7:51 pm

My current BRP is humanitarian protection which is valid until June 2023 and I recently applied for indefinite leave to remain. I was just wondering if I can work while waiting for a decision or not. If no, can I apply for an extension or any other ways like asking the home office for permission to start working while waiting for a decision on my ILR.
Thank you for your help

Provided you applied before the end of your existing leave, whatever rights and restrictions you had on your pre-existing leave would be extended when you apply for ILR.

So, if you could work on your Humanitarian Protection visa, you can continue to work.

If there was any restriction on your ability to work (such as an hourly limit or so), that would also automatically be extended and continue till your application is decided.

Than you for your reply
That’s good news, but I checked gov.uk to check for my right to work and it updated to the indefinite leave to remain photo so my brp is no longer on the system. However, still says expires June which is my pre-existing leave. Does this matter or shall I give it a couple more days as I applied today.

You made an in time application and can continue to work as with every other rights conferred by the leave you currently have. The system may not get updated quick enough and should employer want to check right to work provision is made for that by HO.

Proof of right to work while waiting on ILR decision.

Recently, I applied for indefinite leave to remain, and my current BRP status is on humanitarian protection. As per my BRP, I have been authorized to work until 17th June 2023. Although I have been informed that I can continue working, when asked by an employer to provide a share code as proof of my eligibility to work, the expiry date remains the same as my BRP's. However, my picture has been updated to reflect my indefinite leave to remain status.

That's how it should be, as you haven't yet received a decision on your ILR application.
If you would have to prove your right to work past BRP date, assuming you lodged an in time application for ILR, ask employer to use Employer Checking Service if he wants to make sure you have right to work.
