Hi all
Respected Gurus

After roller coaster nearly 5 years , I am almost there to be eligible for applying ILR (fingers crossed)

Can you please help me with couple of beginner level questions please:
1) I am applying ILR through 5 year Tier 2 general route. Which application form do I need to fill ? Can you send the link please.
2) How soon I can start my application online ? I am due to apply in September. Can I start my application now or will it be deleted by then?

Thanks for your prompt reply @Zimba, can you confirm these:

1) Based on my first visa issued in 2015 and entry in UK when can I earliest apply for ILR ?

Visa Issued 08/10/15 10/09/20 (28 days before 5 years of Visa issued date)
Entry in UK 17/10/15 19/09/20 (28 days before 5 years of Entry in UK)
Current Visa expire 14/01/2021

Is it 17/10/20 after I actually complete 5 years in UK after first entry?

what does apply actually means - book & pay OR appointment date?

2) On the application one requirement is that : your employer (sponsor) still needs you for your job - they’ll need to provide a document confirming this.
Is there a format or sample available ? How recent this letter should be before the appointment date ?

3) What is the latest salary slip we need to submit ? Is it correct that in total we need to submit 60 salary slips? But if we apply 28 days before Entry in UK we might only have 59. Is that ok?

1. You can apply no sooner than within 28 days before the 5th anniversary of your initial visa issue date.

2. No template as such but must state the key information and the foreseeable future bit. https://www.immigrationboards.com/indef ... 76413.html

3. The last payslip and corresponding bank statement before date of application. On the date you apply online, your payslip, bank statement, employer lettet cannot be older than 28 days. Not sure where you got the information that 60 payslips are required. There has never been such a requirement.

sorry sorry sorry for asking many questions.. what I want to clarify is that if I am looking for super premium 1 day appointment then
"28 days before the 5th anniversary of my initial visa due date" can be the appointment date ? or has to be the date when I pay online & submit the application and book appointment for super premium service whenever I get?

The date of application is the date you submit and pay online.

Hi

I am eligible for ILR in couple of months. While looking for documents I just realised that last year while switching employer I forgot to return the old BRP.
What can I do now ?
Will there be any issue for ILR ?

Pls advice, bit worried if this can cause any problem on my ILR

Nothing you need to do. If your ilr is approved, simply return all brp cards.

Hi Gurus

I am applying ILR in Sep through Set O - 5 Year Tier 2 General visa route.
From 2015 - 2018, I was on SOC 2136

a) In 2016, I was on maternity leave during which I only got Mandatory Statutory Pay. Does that affect ILR?

b) Post maternity leave: I was on reduced working hours of 32.5 hours per week earning £34,200 pa.
Is this below minimum requirement (in terms of number of hours or pay)? Does this affect ILR in any way? or Salary requirement is only at the time of ILR application ?

a) No. This is covered in the guidance notes!

b) You are required to meet the salary requirement at ilr stage. If you are still on SOC 2136, this is in the shortage occupation list and you need a minimum of the experienced rate in the SOC based on 39 hours per week

1) Just to confirm, my current SOC code is 2135 (previous was 2136). I checked and even 2135 is in shortage occupation list (though my profile of job is not part of shortage occupation description). Does job code in SOL changes/affects anything on ILR application?

also have some questions please:
2) For the question: Do you have a degree that was taught in English?
I have degree in English but as I dont have transcript/English medium letter due to covid lockdowns I am showing Trinity B1 GESE certificate.
Shall I answer this question: No ?

3) To enter B1 GESE this is the right way:
Did the test assess you speaking & listening at a level equivalent to CEFR B1 or higher? Yes
How did you get your result? Certificate

4) There is a question: Do you have any Home Office reference numbers?
what reference number are they asking ? what format is this number?

I have written questions in detail, this is just to make sure I get all & clear information. All the Gurus/senior members are helping so much, at least I can try to be clear in asking.

4) Its your Case ID. It will be on official emails/approval letters. Usually starts with a 0. Its an “if known” question. Not compulsory. You can also provide your BRP number as reference if you cant find your Case ID.

I got this letter from my previous employer on verification of absences. I can confirm total leaves in 5 years I have is 150 days and max in any 12 months is 55.
1) Does this letter looks fine:

"Ms. AA has taken both company and statutory maternity leave between xxx to yyy. As per s281 of the Tier 2 Policy Guidance (10/2019), we believe you have been provided with the appropriate payslips for not only the period of leave, but also the month directly before leave began.

We confirm that all the absences taken during her employment were within the allocation provided under their employment contract. We believe you have been provided with a full travel history detailing her travel abroad which will cover their period of employment with us, as part of their application."

2) They have also added that during maternity I worked reduced hours with reduced pay (still above salary requirement). Hope that's fine?

3) On the question of have you lived outside UK. I have entered Holidays ranging from 1 day to 32 days when I have lived outside UK. Is that fine ? or else what is the criteria for 'lived' , at least 1 night ?

Apologies for asking this again but I waited for a week and think this might have been missed..

The letter for holiday that I received (point 1 below) doesn't mention specific dates. Is that ok ? I have 150 total leaves outside UK in 5 years.

It is only the BRP.

1. No.

2. Yes, you need an employer letter about your absences and detailing your employment and CoS details. This is mandatory.

on one of the thread I read to write a cover letter explaining why am I not applying for dependent to save time as HO might ask for child safety.

Shall i write a cover letter saying why I am not applying for ILR of my dependent at the same time with this information:
- Spouse: Not applying together as not eligible with me
- Child NOT born in UK: Not applying together as not eligible with me and Spouse not on ILR yet
- Child born in UK: Will apply for British Citizenship once I get my ILR and hence not applying their ILR together with mine

Will that be ok ?

This applies ONLY to a scenario where a UK born child is NOT applying with parents. It does NOT apply to your circumstance where your dependents don't yet qualify for ILR. UKVI do actually know the rules.

No!!

Not required if the child has a visa valid the same as the other parent.

Hi,

I have a question on my previous visits to UK (prior to starting my 5 year period after out of country application in 2015)
- I was in UK from May 2014 to Sep 2016 on Tier 2 ICT dependent
- Before that I visited UK few times as visitor / tourist

In the application, it nowhere asks for previous visits to UK (only visits to countries other than UK). Do I need to mention UK visits separately or no need as they might already have record ?
